Comments:
The unannounced non-mandated inspection was completed on 03/15/2019 from 10:30 A.M.-12:47 P.M. The inspection was in response to a complaint that was received in the Valley Licensing Office on March 14, 2019 regarding forbidden actions. Interviews with staff, attendance sheets, two staff records, one child record, parent handbook, employee handbook, and video footage from 03/13/2019 were reviewed. The information gathered during the investigation does support the allegation, so the allegation is determined to be "valid". The exceptions to compliance are noted on the violation notice. Complaint related: Yes
Description: Based on review of policies and procedures and classroom video footage dated 03/13/2019, the operational responsibilities of the licensee did not ensure that the center's activities and services are maintained in compliance with the center's own policies and procedures that are required by these standards. Evidence: 1. The center did not follow their policy for Acceptable and Unacceptable Discipline located in the Parent Handbook. The handbook states," Directions will be positively-worded to redirect children to acceptable behavior. The children will be helped to constructively express their feelings and frustrations to resolve conflict. Staff members will not use any form of physical punishment." 2. On 03/13/2019, there were two staff supervising nine children between the ages of two and three in Classroom A. 3. At approximately 11:08 A.M., Staff did not intervene when Child A was throwing toys at two other children in the back of the classroom. Staff #2 was positioned in the front of the classroom to the left of the entrance and facing the children in the back of the classroom. Staff #1 was in the classroom bathroom. 4. At approximately 11:10 A.M. Child A was hitting Child C with a toy. Child A pushed Child C causing Child C to hit his head on the table. Child C touched his head as he walked over to Staff #2 who is facing the children. Child C went up to Staff #2 and pointed to the side of his head. Staff #2 walked over to a chair and sat down by other children. 5. At approximately 11:20 A.M., Staff #2 was sitting in the back of the classroom putting toys in a basket when Child B began playing with the light switch by the front entrance of the classroom. Child A ran over to the light switch and pushed Child B onto the floor. Child B pulled Child A away from the light switch. Child A hit Child B. Staff #2 was observed speaking while she remained seated on the floor in the back corner of the classroom putting toys in a basket; Staff #1 exited the classroom bathroom, went to get lip balm and walked by Child D, who was sitting on top of a table. Meanwhile, Child B began hitting Child A on his head with a toy. Child A walked over to Staff #1 with his hand on his head and tapped her leg. Staff #1 looked at Child A and continued to apply lip balm. Child A walked away, dragged a chair over to the light switch, climbed onto the chair and began cutting the lights on and off. Staff #1 walked over to Child A and forcibly yanked the chair out from underneath the child causing him to fall head first on the floor.

Plan of Correction: 1. Administration will schedule training will schedule training for the staff which will focus on behavioral guidance and developmental milestones. (Ages & Stages-what is appropriate and expected behavior at certain ages.) 2. Administration will schedule weekly observation times in the classroom and provide feedback and suggestions. 3. Administration will encourage self-reflection by the staff viewing the video, asking questions, and discussing both the positive and challenging areas. 4. There will be ongoing mentoring through Virginia Quality. This is to include classroom schedule, classroom arrangement set up to minimize behavioral issues. 5. Infant Toddler Specialist is working with identified needs. This will provide one-on-one support for those children as well as a resource for the teachers to best provide for specific needs of children in the class.

Description: Based on a review of staff records and interview with administrative staff, all required information was not in a staff file. Evidence: 1. Staff #2 was hired on 08/13/2018 as a Lead Teacher. The record did not contain documentation that the individual possesses the education required by the job position. 2. Administrative staff verified that documentation of completed education was not in the staff file.

Plan of Correction: A line item has been added to the Employee documentation list to ensure it is obtained in the future. Staff #2 immediately asked to obtain verification of education and qualifications.

Description: Based on a review of the center's written policies and procedures and interviews with administrative staff, staff were not provided in writing with all required information by the end of the first day of supervising children. Evidence: 1. Documentation provided to staff did not contain the following required information; procedures for supervising a child arriving after scheduled classes or activities including field trips; procedures to confirm absence of a child when arriving from another program or agency; procedures for identifying where attending children are at all times, including field trips; procedures for lost or missing children, ill or injured children, medical emergencies and general emergencies; policies for administration of medication; procedures for response to natural and man-made disasters, and all information required to be provided to parents in writing before a child's first day of attendance. 2.Administrative staff verified the required policies were not included in the written information that employees are provided upon hire.

Plan of Correction: Administration will look at the employee handbook to ensure the additional information needed is included.

Description: Based on review of video footage and interviews, the center failed to ensure care, protection, and guidance of children in the center's care. Evidence: 1. On March 13, 2019 there were nine children ranging from two years of age to three years of age with Staff #1 and Staff #2. At approximately 11:08 A.M. Staff did not intervene when Child A was throwing toys at two other children in the back of the classroom. Staff #2 was positioned in the front of classroom to the left of the entrance and facing the children in the back of the classroom. Staff #1 was in the classroom bathroom. 2. At approximately 11:10 A.M., Child A was hitting Child C with a toy. Child A pushed Child C causing Child C to hit his head on a table. Child C touched his head as he walked over to Staff #2 who was facing the children. Child C went up to Staff #2 and pointed to the side of his head. Staff #2 walked over to a chair and sat down by other children. 3. At approximately 11:14 A.M., Child A was throwing toys across the room which were landing on the colored circle rug where another child was sitting and playing. Child A then went to the kitchen area picked up a storage container and threw it across the room landing on the colored circle rug behind a child playing. Staff #2 is positioned in the front of the classroom to the left of the entrance facing the children drinking a beverage. 4. At approximately 11:20 A.M., Staff #2 was sitting in the back of the classroom putting toys in a basket when Child B began playing with the light switch by the front entrance of the classroom. Child A ran over to the light switch and pushed Child B onto the floor. Child B pulled Child A away from the light switch. Child A hit Child B. Staff #2 was observed speaking while she remained seated on the floor in the back corner of the classroom putting toys in a basket; Staff #1 exited the classroom bathroom, went to get lip balm and walked by Child D, who was sitting on top of a table. Meanwhile, Child B began hitting Child A on his head with a toy. Child A walked over to Staff #1 with his hand on his head and tapped her leg. Staff #1 looked at Child A and continued to apply lip balm. Child A walked away, dragged a chair over to the light switch, climbed onto the chair and began cutting the lights on and off. Staff #1 walked over to Child A and forcibly yanked the chair out from underneath the child causing him to fall head first on the floor. Child A is seen placing his hoodie up on his head as he and Staff #1 walked to a carpet area.

Child C touched his head as he walked over to Staff #2 who was facing the children. Child C went up to Staff #2 and pointed to the side of his head. Staff #2 walked over to a chair and sat down by the other children. 2. At approximately 11:20 A.M., Child B, age 2, was hitting Child A, age 2, over the head with a toy. Child A walked over to Staff #1 with his hand on his head and tapped her leg. Staff #1 looked at Child A and continued to apply lip balm. Child A walked away.

Evidence: 1. At approximately 11:10 A.M. Child A, age two, was hitting Child C, age 2, with a toy. Child A pushed Child C causing Child C to hit his head on the table. Child C touched his head as he walked over to Staff #2 who is facing the children. 2. At approximately 11:20 A.M., Staff #2 was sitting in the back of the classroom putting toys in a basket when Child B began playing with the light switch by the front entrance of the classroom. Child A ran over to the light switch and pushed Child B onto the floor. Child B pulled Child A away from the light switch. Child A hit Child B. 3. Description: Based on review of classroom video footage dated 03/13/2019 and interviews, the center failed to ensure that children were not roughly handled. Evidence: At approximately 11:14 A.M., Staff #2 was observed redirecting Child A. As Staff #2 walked over to the child, he darted underneath a table with chairs. Staff #2 pulled the child out and lifted the child up by one arm.

Plan of Correction: 1. Administration will schedule training for the staff which will focus on behavioral guidance and developmental milestones. (Ages & Stages-what is appropriate and expected behavior at certain ages.) 2. Administration will encourage self reflection by the staff by reviewing the video, asking questions, and discussing both the positive and challenging areas. 3. Administration will schedule weekly observation times in the classroom. 4. There will be ongoing mentoring through Virginia Quality. Description: Based on review of center documentation and interviews with administrative staff, the center failed to provide parents with all required information in writing before the child's first day of attendance. Evidence: 1. The center's parent handbook was missing the following information: transportation policy; policy for application of sunscreen, diaper ointment, and insect repellent; established lines of authority; the custodial parent's right to be admitted to the center; and termination policy. 2. Administrative staff verified that the parents were not provided with all required information in writing before the child's first day of attendance.

Plan of Correction: Administration will look at the parent handbook to ensure the additional information is included.

Standard #: 22VAC40-185-550-M
Complaint related: Yes
Description: Based on review of accident reports and interviews, the center failed to ensure that a written record of a child's serious and minor injuries were completed on the day of occurrence. Evidence: 1. The center did not document that Child A fell head first onto the floor when Staff #1 forcibly yanked a chair out from underneath him. 2. Staff #1 and Staff #3 confirmed that a written record of the injury was not completed.

Plan of Correction: Accident reports are regularly filled out, however this one was not completed. Staff were reminded to consistently follow this procedure. When notes that it was missing it was immediately completed.
