Comments:
An unannounced complaint investigation was initiated with a representative of a local agency on March 5, 2019 to investigate a complaint that was received on March 4, 2019. Based on staff interviews and review of written statements, the allegations made by the complainant regarding forbidden actions was determined to be valid. *Please complete the plan of correction and date to be corrected for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Description: Based on review of written documentation of the facility's policy, the center failed to ensure compliance with its own policies that are required by the standards. Evidence: Staff interviews and written documentation confirmed that on 3/5/2019, the centers policy on disciplining children was not followed by Staff 1, when Child 1 was "slammed on to his mat" and "smacked" in the face. The center's discipline policy in the employee handbook states that "The following actions may result in immediate termination. Neglect or physical abuse of a child." The parent handbook states, "No child will be hit, spanked, belittled or otherwise intimidated, even with parental permission. No corporal punishment shall be used."

Description: Based on written documents and staff interviews, the facility failed to report any suspected incident of child abuse or neglect in accordance with 63.2-1509 of the Code of Virginia. Evidence: The facility did not report an incident to Child Protective Services that occurred at the center on February 26, 2019 after a staff member hit and roughly handled a child in care. Staff acknowledged that a call should have been placed to Child Protective Services due to the incident. Staff E reportedly thought Staff F had made the report. Staff F reportedly thought Staff E made the report.

Description: Based on review of written documents and staff interviews, the facility failed to prevent the forbidden action of striking a child. Evidence: on February 26, 2019 at 1:30 p.m. during rest time, two staff witnessed the following: 1. Staff B and C were supervising the children during rest time. Child 1 (age 3) was not settling down on his mat. 2. Staff A "picked up [Child 1] and slammed him down onto his cot. [Child 1] got off his cot again crying and threw a chair". 3. Staff A "grabbed the child forcibly by his arm and told him to 'Stay down'". 4. Child 1 sat up, and Staff A "smacked" him with an open hand on his face. Staff B and C reportedly saw and heard the "smack". Staff A reportedly stated "Oh, I didn't mean to hit him that hard." and left the room.

Description: Based on review of written documents and staff interviews, the facility failed to prevent the forbidden action of forcing rest. Evidence: on February 26, 2019 at 1:30 p.m. during rest time, two staff witnessed the following:
1. Staff B and C were supervising the children during rest time.
2. Child 1 (age 3) was not settling down on his mat, so Staff A picked up Child 1 and "slammed" him down onto his cot. Child 1 got off his cot again crying and threw a chair, so Staff A grabbed the child "forcibly by his arm" and told him to "Stay down".
When Child 1 sat up again, Staff A "smacked" him with an open hand on his face.
