22VAC40-73 RESIDENT CARE AND RELATED SERVICES
The licensing inspector conducted an unannounced complaint inspection on 8-23-18 in response to a complaint that was received by the licensing office on 8-21-18. Interviews were conducted with facility staff member and collateral individual, record review conducted and documents regarding allegation of request for resident's record by the resident's legal representative not provided. The information gathered during the investigation support the allegations, so the complaint is determined to be "valid". There were other non-complaint violations resulting from this complaint investigation. Please complete the columns for "description of action to be taken" and "date to be corrected" for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 10 calendars of receipt. Standard #: 22VAC40-73-560-G Complaint related: No Description: Based on document review and staff interview, the facility failed to ensure the legal representative was provided access to the resident's record. Evidence: 1. During the inspector's interview on 8-23-18 with staff #1 regarding a complaint received by the licensing office on 8-21-18 of resident #1?s legal representative not receiving records as requested from the facility sometime in July 2018, following being informed of the facility?s decision to discharge resident #1. Staff #1 stated the records were in a box; staff #1 showed the inspector a box located on the floor in staff #1's office. Staff #1 also stated, taking the box of documents to resident #1's legal representative's lawyer on 8-22-18". 2. The inspector inquired of staff #1, when resident #1's family member/legal representative requested the records, did staff know the date the request was made. Staff #1 stated, ?? did not remember the date and the request was made in a brief passing with resident #1's legal representative". 3. A review of the facility?s document ?Discharge Notification and Statement) noted the notification of discharge to the legal representative was 7-16-18. The document also indicated the ?date of discharge statement provided to?.legal representative was completed on 7-26-18?. The document is also signed and dated by staff #1 on 7-26-18. 4. The inspector inquired of staff #1, the reason for not providing the records when resident #1's legal representative requested and asked if staff #1 had received a letter from the lawyer for resident #?1?s legal representative dated 8-6-18, requesting resident #1?s records. Staff #1 stated receiving the letter. Staff also stated, ?waiting to provide the documents to resident #1's legal representative because staff # 1 wanted to provide the full record, including the discharge documents?. 5. Staff #1, confirmed not providing the documents directly to resident #1's legal representative. Plan of Correction: It is Spring Arbor of Williamsburg?s policy to comply with all state regulations regarding resident?s records. Upon request from legal representative as allowed by the scope of his/her legal authority records will be provided within 30 days as outlined per facility policy. Date of Correction: 8/22/2018
