22VAC40-73 RESIDENT CARE AND RELATED SERVICES

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 7/07/2020 and concluded on 7/08/2020. A complaint was received by the department regarding allegations in the areas of resident care. The administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the administrator a list of documentation required to complete the investigation. The evidence gathered during the investigation did not support the allegation of non-compliance with standards or law. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice. Please specify how the violation will be corrected. The plan must contain: 1) step(s) to correct the non-compliance with the standard(s), 2) measures to prevent the non-compliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Standard #: 22VAC40-73-440-A Complaint related: No Description: Based on a review of a resident record as well as a phone interview with the facility administrator, the facility failed to update the resident's Uniform Assessment instrument (UAI) when there was a significant change in the resident's condition.
Evidence:
Resident # 1's (date of admission: 10-1-19) UAI (dated 10-1-19) noted the following:
-Resident "Needs no help" with Medication Administration and "without assistance" is marked. However, the administrator stated that the facility administers the resident's medications. The UAI was not updated to reflect that the resident's medication is administered by staff.
-UAI also noted that resident is "Oriented". However, the administrator stated that the resident "has some memory loss and cannot remember administrator's name." Resident's most recent Physical Examination Report (dated 3-21-2020) also notes "Memory Loss" under Diagnosis or significant problems. The UAI was not updated to reflect "Disoriented- some spheres all of the time".
-UAI noted that the resident needs no help walking, however, the administrator stated that the resident's physician ordered physical therapy (PT) and client was assessed by PT and a cane was ordered. Administrator stated that the resident refuses to use the cane and tries to walk without it. The UAI was not updated to reflect the need for mechanical assistance.Plan of Correction: A new UAI and ISP were completed on the resident.
Standard #: 22VAC40-73-450-C Complaint related: No Description: Based on a review of a resident record, the facility failed to ensure that the resident's Individualized Service Plan (ISP) contained a written description of all identified needs and services provided to address identified needs.
Evidence:
The ISP (last dated 11-1-19) for Resident # 1 was not updated to address the resident's identified needs as described by the administrator during phone interview with the Licensing Inspector. The ISP was not updated to reflect the identified need of medication administration, the use of a cane for mechanical assistance with walking, or the identified need of orientation/memory loss.Plan of Correction: A new ISP was completed on the resident.
