22VAC40-73 RESIDENT CARE AND RELATED SERVICES

Comments:

This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia. Two self reported incidents were received by the Department on 1/31/2021 and 3/18/2021 regarding a resident in care. The licensing inspector reviewed the incident reports and communicated with facility staff. Evidence gathered during the investigation supported non-compliance with applicable standards or laws, and the violations are documented on the violation notice issued to the facility

Violations:

Standard #:	22VAC40-73-460-A
Description:	Based on a review of a self reported incident, the facility failed to assume general responsibility for the health, safety and well being of a resident in care. Evidence: 1 An incident report was received by the Department on 3/18/2021. It was reported that a resident (#1) in the secure memory care unit had ingested a COVID applicator tip with reagent on it. According to the report, applicators for testing were left on a table in the dayroom while waiting results to register. Residents in the secure memory care unit are diagnosed with a serious cognitive impairment and an inability to recognize danger or protect their own safety and welfare. Access to the applicator tip placed the resident at risk of health, safety and well being. .
Plan of Correction:	All COVID testing for employees will take place in a secure office space within the community. Employee testing will no longer be allowed on the units. This removes the risk of a memory care resident coming in contact with COVID testing supplies.
Standard #:	22VAC40-73-460-D
Description:	Based on an incident report received on 1/31/2021, the facility failed to provide supervision of a resident's schedule , care and activities, including attention to specialized needs such as wandering from the premises. Evidence: Resident wandered from the secure memory care unit on 1/31/2021. The resident has a serious cognitive impairment and is unable to protect his own health, safety and welfare. Staff reports that it is unknown how resident was able to exit the unit.
Plan of Correction:	Fire exit door codes were changed immediately. Staff are no longer allowed to use the fire emergency doors as an exit or entrance and doors will be used as a Emergency Exit door only. Staff are required to perform a head count of residents at the beginning of the shift to ensure that all residents are accounted for and fire exit door is secure.
