63.2 Facilities and Programs..

Comments:
A non-mandated self-report inspection was initiated on 4/29/21 and concluded on 7/15/21. A self-reported incident was received by the department regarding an allegation in the area of: Resident Care and Related Services. The administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the administrator a list of documentation required to complete the investigation. The licensing inspector conducted on-site observations at the facility on 6/28/21 and 7/15/21.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law, and a violation was issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 63.2-1808-A-10
Description: Based on documentation and interview, the facility failed to ensure that residents are free from physical abuse.
Evidence: A facility incident report indicated that on 4/13/21, Staff #1 slapped and pushed Resident #1. The incident was witnessed by Staff #2. Staff #2 reported that she witnessed Staff #1 slap Resident #1 in the back of the head, and push the resident between the shoulder blades. Staff #2 reported that the incident started after Resident #1 began eating food from a plate that was located in the kitchen. After the incident, Staff #2 witnessed Resident #1 crying.

When interviewed, Staff #1 said that she didn't hit Resident #1, but "tapped" her on the head and her shoulders, and asked the resident "why did you do that?" The record for Resident #1 includes an assessment for serious cognitive impairment, dated 10/15/18, that states that the resident has a serious cognitive impairment, and she is unable to recognize danger or protect her own safety and welfare. The record for Staff #1, a resident caregiver/medicine aide technician, includes job descriptions dated 5/16/19. The descriptions require each staff member to interact in a tactful, diplomatic, and humanistic manner with residents, families, visitors, and co-workers to provide a safe, efficient, and therapeutically effective caring environment which ensures the self-respect, personal dignity, rights and physical safety of each resident and facility guest.

Facility training records indicate that Staff #1 attended an Abuse and Neglect in-service on 4/12/21. Facility training materials were observed during the inspection. The facility's training material reports that "physical abuse can range from slapping or shoving to severe beatings and restraining with ropes or chains. When a caregiver or other person uses enough force to cause unnecessary pain or injury, even if the reason is to help the older person, the behavior can be regarded as abusive. Physical abuse can include hitting, beating, pushing, shoving, kicking, pinching, burning, or biting. It also includes the inappropriate use of medications and physical restraints and physical punishment of any kind."

Plan of Correction: Staff member was removed from the house where the incident took place and has not worked there since the incident. Staff member, as well as all staff, participated in an additional in-service on abuse and neglect. All staff will participate in an annual in-service on abuse and neglect.
