22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
Consultation was given on the new background requirements for finger printing, a revised Sworn Statement (SDS) for new staff hired after 7/1/2017 and requesting out-of-state Central Registry checks for staff who have lived outside of Virginia within the last five years. The model SDS form is online at VA DSS as well as a link to the Adam Walsh site to assist with out-of-state central registry forms. VA DSS will be paying for initial child care finger print checks until 9/30/2018. Each facility must establish a point of contact with VA DSS. All questions regarding facility codes should be directed to OBI at 804-726-7884. Eligibility letters will be sent out by e-mail and staff may not be hired until the completed letter is received. Please read, review, and respond to all correspondences regarding the fingerprint roll out. **Discussion held on the subject of Medication Administration Training and which course meet the requirement.

An unannounced monitoring inspection was conducted today from 8:45am-11:00am. At the beginning of the inspection there were 12 children directly supervised by 6 staff. The physical plant, 4 staff records, 4 children?s records, 2 medications, evacuation drills, injury reports, emergency supplies, and policies were inspected. Children were observed participating in playing outdoors, one staff was playing with a child indoors, and eating a lunch consisting of chicken or veggie nuggets, watermelon, mixed vegetables and milk. There was an abundant supply of materials for the children. The center was clean and organized. Areas of non-compliance are identified in the Violation Notice. Standard #: 22VAC40-185-270-A
Description: Based on observation, not all equipment outside the center was maintained in a safe and operable condition. Evidence: 1. On the playground a bicycle was observed with broken handlebar grips exposing a sharp metal tube where children's fingers can become trapped. 2. On the playground three planter pots were observed with peeling paint. 3. On the playground two plastic storage containers were observed with cracked lids.

Plan of Correction: We will put the bicycle away until replacement parts can be ordered and installed. We will remove the planters and the cracked lids today.

Standard #: 22VAC40-185-280-B
Description: Based on observation, not all hazardous substances were kept in a locked place using a safe locking method that prevents access by children. Evidence: 1. Four chemical sponges were observed unlocked in the art classroom. 2. An aerosol canister of air freshener was observed on the paper towel dispenser in the boys restroom.

Plan of Correction: We will lock up the chemicals immediately.

Standard #: 22VAC40-185-510-G
Description: Based on medication review, the center had agreed to administer prescription medication that would normally be administered by a parent or guardian to a child without obtaining the required authorizations. Evidence: The medication authorization for Child 2 did not include a authorization to administer medication from the parent.

Plan of Correction: The parent will be given the form to be completed today at pick up. The doctor has already filled out the other section of the medication authorization.

Standard #: 63.2-1720.1-B-3
Description: Based on record review, the child day center did not obtain a copy of the results for staff of a search of the central registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him or her. Evidence: One of the four staff records reviewed Staff 1 has lived out of the state of Virginia in the preceding 5 years, and no out of state child abuse and neglect results were obtained.

Plan of Correction: The requests for the out of state background checks were submitted while the inspector was finishing the inspection. The results will be filed in the employee's file when they arrive.
