Comments:
An investigation was conducted on 8/2/2016 in response to a self-reported incident received by our office regarding the supervision of a Pre-Kindergarten child. Based upon multiple interviews, and a review of documentation, the incident is deemed valid. Areas of non-compliance are identified in the Violation Notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on documentation review, the center failed to maintain compliance with its' own policies and procedures that are required by the standards regarding sight and sound supervision. Evidence: 1. On 7/27/2018, the children in the Pre-Kindergarten class (ages 4-5 years) were lying down in the PS/PK playground area drying off after water play. Child #1(5 years old) was climbing on the playground equipment (Photo #1). Approximately one to two minutes after being asked to get off of the equipment, Child #1 walked over to Staff A and Staff B with their arm extended straight out, as if unable to bend their arm. Later that day, Child #1's parents informed the Director that the child had a broken arm. 2. At the time of the incident, Staff A and Staff B were stationary, facing the front of the playground equipment (Photo #2). Staff C was stationary to the right side of the playground equipment (Photo #3). No staff were positioned to see the backside, slide area, of the playground equipment (Photo #4). 3. The center's Sight and Sound Supervision Policy, states that "All staff members should continuously monitor all areas of the playground by walking around and engaging in developmentally appropriate gross motor play, paying special attention to climbing equipment, hiding spaces, and blind spots." The policy also states that, "Staff should position themselves in zones so all areas of the playground equipment are covered." 4. The center's Playground Safety Plan states that, "Staff will spread themselves out on the playground to make sure all areas of the playground are covered. These points of interest should be maintained at all times: 1. Staff should be standing North, South, East, West of the playground. They should be watching the activity of the children at all times."

Plan of Correction: Administrators reviewed The Sight and Sound Supervision Policy, The Playground Safety Plan & Procedures for Walks and Buggy Rides, and best practices for communication as it relates to appropriate supervision of children with all three teachers. A memo/written warning for each teacher is in the process of being written. Current policies listed above will be reviewed and revised at an upcoming Director?s meeting to include more detail regarding appropriate supervision of children and playground safety. Administrators are currently devising a zoning chart to assign each teacher, in every class, to a zone on the playground to help ensure adequate supervision of all children at all times. Zones will be assigned and communicated with staff each day. A master zoning chart will be kept at the front desk and a copy of the chart will be distributed to each class with the daily staffing schedule. Additional improvements not listed above may be added during upcoming Director?s meeting. Zoning chart and current policies and any updates related to policies listed above will be reviewed with all staff during Professional Development Day on Friday, August 31, 2018.

Description: Based on staff interview, 3 staff did not ensure the care, protection, and guidance of all children under their supervision. Evidence: 1. On 7/27/2018, the children in the Pre-Kindergarten class (ages 4-5 years) were lying down in the PS/PK playground area drying off after water play. Child #1 (5 years old) was climbing on the playground equipment (Photo #1). Approximately one to two minutes after being asked to get off of the equipment, Child #1 walked over to Staff A and Staff B with their arm extended straight out, as if unable to bend their arm. Later that day, Child #1's parents informed the Director that the child had a broken arm. 2. During an in-person interview on 8/2/2018, the Director stated that Child #1 told their parents that they jumped off of the slide and fell on their arm. The slide is positioned on the backside of the playground equipment (Photo #4). 3. At the time of the incident, Staff A and Staff B were stationary, facing the front of the playground equipment (Photo #2). Staff C was stationary to the right side of the playground equipment (Photo #3). No staff were positioned to see the backside, slide area, of the playground equipment.
