22VAC40-185 STAFFING AND SUPERVISION.

Comments:
On 6/28/18 the department received a complaint alleging non-compliance with standards in the area(s) of supervision of children. A complaint investigation was initiated on 7/2/18 and concluded on 7/5/18. The licensing inspector was on site at the center on 7/2/18 and 7/5/18. On 7/2/18 one staff member was interviewed, on 7/5/ 18 four staff members were interviewed along with the involved child in the presence of an additional local agency. On 7/5/18 center written procedures for accounting for children were requested and the involved child's record was reviewed. The evidence gathered during the investigation supported the allegation of non-compliance with standards in the areas of supervision of children and violations were cited. Additional violations identified during the course of the investigation in the areas of operational responsibilities and staff training and development were cited as a result of the complaint investigation and can be found on the violation notice. An exit with the Program Director took place on 8/22/18 via phone at the request of the Program Director and the the Violation Notice was sent to the PD on the same day. Please provide a plan of correction, date to be corrected and signature on the issued Violation Notice no later than the close of business day on Monday, August 27th.

Description: Based on interviews, the licensee did not ensure that the operational responsibility of the centers activities and services were maintained in compliance with policy and procedures that are required by these standards to include procedures for identifying where attending children are at all times and ensuring that all children are accounted for before leaving a field trip. Evidence: 1.) Staff #4 was not able to demonstrate that the center has a written procedure for identifying where children are at all times and ensuring and that all children are accounted for before leaving a field trip site. 2.) Staff #4 stated that procedures for accounting for children are reviewed verbally with staff. 3.) Staff #1 stated that she received Child #2 from the parent and did not add Child #2 to the list of day care children at the pool. 4.) Staff persons #1, #2, and #3 were not aware that they had left Child #1 at the pool until a pool staff person notified a center staff person that the child was still at the pool.

Description: Based on interview, the center did not provide to staff by the end of the first day of supervising children, written information on procedures for identifying where attending children are at all times and ensuring that all children are accounted for before leaving a field trip site. Evidence: Staff #4 stated the center does not give a written procedure for accounting for children at all times; the procedure for accounting for children at all times are reviewed "verbally" with new staff during their orientation.

Description: Based on the interviews and reviews of documentation, the center did not ensure that staff supervising children always ensure children's care and protection. Evidence: 1.) On 6/28/18, staff supervising a field trip to a local pool, left a six year old, Child #1, alone and unsupervised at the pool when they had 31 children in care and lined up only 30 children for the transport back to the day center at the conclusion of the the field trip. 2.) Staff were not aware that they left Child #1 at the pool until a pool staff person notified a center staff member that the child was left at the pool. 3.) Staff stated that they arrived at the pool with a total of thirty children and an additional child, Child #2, transported separately by the child's parent, arrived later at the pool to join the day care group. Due to the late arrival of Child #2 there were a total of 31 children within the day care group at the time of departure. 4.) Staff #1 stated that she received Child #2 from the parent and did not add Child #2 to the list of day care children at the pool. 5.) Staff #1, #2, and #3 stated that when leaving the pool, they left and accounted for 30 children.

Description: Based on interviews a child under 10 years of age was not always within actual sight and sound supervision of staff. Evidence: 1.) On 6/28/18. four staff persons left Child #1, a six year old child, alone and unsupervised at a local pool for approximately seven minutes. 2.) Staff persons were not aware that they left Child #1 at the pool until a pool staff member notified a center staff member that the child was still at the pool.
