Technical Assistance:
Discussion was held on the topics of current enrollment, current staffing, and training. Discussion of the newly obtained finger print checks. These national background checks replace the criminal record checks done through the state and are good for 5 years. In addition, the existing search of the central registry (CPS) checks and Sworn Disclosure Statements (SDS) are retroactively good for 5 years from the date of finding (for CPS) or completion (for SDS). As a reminder, new employees will not be allowed to start until an ?Eligibility Letter? is on file, and any new staff person who lives or has lived outside of Virginia within the past 5 years will need to have an out-of-state CPS check requested to be placed in their file as well.

Comments:
The following inspection took place between the hours of 9 am through 11:30 am. Today, I met with the Staff of the Lovettsville Montessori School located in the town of Lovettsville, Virginia. At the start of this unannounced monitoring inspection there were a total of 24 children with 4 staff; good ratios in all 3 groups. A total of 5 children?s files and 5 staff files were reviewed. The children were engaged in the following: learning, centers within the classroom, bathroom breaks, hand washing, writing, projects, getting ready for lunch, and other organized activities. Violations:
Standard #: 63.2-1720.1-B-3
Description: Based on review and interview, 1 of 5 staff files reviewed indicated that the authorized child day center did not obtain a copy of the results of a search of the central registry (CPS check) maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him or her. Evidence - 1. On the date of inspection (09/07/2018), Staff #4 listed on the completed Virginia's Search of the Central Registry that she had lived in both the State of Maine, and the State of Maryland within the past five years. 2. An out-of-state CPS check from Maine or from Maryland for Staff #4 were not available for review. 3. Staff #1 stated (during an interview conducted on the date of inspection) that these requests have not yet been sent. 4. The start date for Staff #4 was listed as 08/01/2016.

Plan of Correction: A request for a CPS check from the State of Maryland and from the State of Maine for Staff #4 shall be submitted within the next 10 days. Proof that these requests were sent shall be forwarded to our Licensing Inspector (LI). Once these results have been returned, our LI shall be contacted in order to review this documentation. The documentation shall then be placed on file at the center. All applicable staff, who live or have lived outside the Commonwealth of Virginia in the last five years shall have an out of state CPS check completed on them. These results shall be placed in the applicable file.
