We discussed the requirements for background checks. The risk assessments for violations were provided. Also, we reviewed requirements for staff training, tuberculosis statements, outdoor maintenance, and written policies and procedures.
Thank you for your assistance during the initial inspection conducted from 10:30 AM to 2:30 PM and from 3:34 PM to 4:25 PM on October 9, 2018 and on October 11, 2018 from 12:28 PM to 5:10 PM. I viewed indoor and outdoor areas, emergency supplies, emergency planning, diapering equipment, agency inspection reports, three staff records, staff qualifications, staff training, background checks for business entity representatives, and policies and procedures. Issuance of a conditional six month license will be issued upon receipt of all required background checks for business entity representatives. Standard #: 63.2-1720.1-B-2 Description: Based on a review of background checks for three business entity representatives, and interviews with administrative staff, the organization staff and agents did not ensure that any individual required to undergo a background check in accordance with the Code of Virginia submitted to fingerprinting for the criminal history records and obtain the results by September 30, 2018, including business entity representatives who held offices of the corporation as of January 22, 2018. Evidence: The licensing staff communicated with administrative staff in advance of the October 9, 2018 about the required fingerprint results that needed to be viewed for business entity representatives during the initial licensing inspections and for approval of each license. An e-mail notice to administrative staff and phone conversations occurred on Friday, October 5, 2018. During the record review on October 9, 2018, the licensing inspector requested to view the fingerprint findings completed with the Office of Background investigations for BE1, BE2 and BE3. The only record available was an eligibility finding dated on October 9, 2018 for BE1. The licensing inspector was told that the Fieldprint fingerprint appointments were attended by BE2 on October 5, 2018 and on October 9, 2018 by BE3. During the continued record review on October 11, 2018, the licensing inspector was present when an administrative staff called the Office of Background Investigations and was told the background check for BE2 and BE3 were in process. The results were received for BE 2 and BE 3 and passed on to the licensing inspector on October 12, 2018. Plan of Correction: Administrative staff began arranging fieldprint appointments for all three business entity representatives on October 5, 2018. Administrative staff contacted the Office of Background Investigations on October 11 and 12, 2018 to inquire about the processing of the background checks for BE 2 and BE3 which were received on October 12, 2018 for the requirements of the initial license. An administrator will assign a staff person in each licensed program to attend to all communication in licensing. Also, an administrator will assign a staff person in each licensed program to ask the state licensor if there are any new regulations during unannounced inspections. An administrator will ensure that the administrative assistant/HR understands and tracks background checks for all staff and anyone connected with the state child care license on the application (Child Development Institute Head Start board officers) and all staff.
Standard #: 63.2-1720.1-B-3 Description: Based on a review of background check results for three business entity representatives, and interviews with administrative staff, a copy of the results of the searches of any child abuse and neglect registry or equivalent registry maintained by any other state in which the three individuals have resided in the preceding five years were not obtained as required by September 30, 2017 to determine if there were any founded complaints of child abuse or neglect against them. Evidence: During the record review on October 9, 2018, the inspector requested to see the out-of-state child abuse registry findings for BE1, BE2 and BE3. An administrative staff person contacted staff at another licensed Virginia program to obtain the information from their files. Administrative staff told the licensing inspector that staff at the other program did not find the documentation in the files and that the child abuse registry requests had not been completed as required between July 1, 2017 and September 30, 2017. Administrative staff and the business entity representatives disclosed that BE1 has been living in one other state, BE2 has lived in two other states, and BE has been living in one other state during the previous five years. Plan of Correction: Administrative staff immediately began to follow the procedures for the Adam Walsh state contacts and request the child abuse registry findings and notified the three business entity representatives for assistance with this process. The results were obtained by e-mail from all four states by October 11, 2018. An administrator will assign a staff person in each licensed program to attend to all communication in licensing. Also, an administrator will assign a staff person in each licensed program to ask the state licensor if there are any new regulations during unannounced inspections.
