63.2 Licensure and Registration Procedures

Comments:
This facility was placed on probation for 12 months due to issues involving operational responsibilities of the facility, supervision of the children, behavior guidance and forbidden actions. An unannounced focused inspection was conducted on 10/31/18 from 9:30am - 10:30am to ensure compliance with the special order. During the inspection there were 18 children ages seven months old to four years old in care with seven staff. A tour of the facility was conducted and children were observed participating in various classroom activities. While the facility was in compliance with the terms of their probation, a violation was cited in the area of background checks. The area of non-compliance is identified on the attached violation notice and was discussed during the exit interview.

Violations:
Standard #: 63.2-1720.1-A
Description: Based on a review of one staff record, it was determined that the licensee did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing). Evidence: 1. The record for staff #1 (date of hire 10/22/18), working during the inspection, contained documentation of a completed national criminal record check (finger printing) that was dated 10/23/18. 2. Staff #1 (Program Director) confirmed that she began employment prior to the facility receiving the results of her national criminal history record check (finger printing).

Plan of Correction: The facility responded: Staff #1 started at the center after completing the request for a criminal record check was completed on 10/19/18, but prior to receiving the results as there was no Program Director at the facility. Going forward, no staff will begin employment until the results of the national criminal history record check (finger printing) is received.
