22VAC40-185 SPECIAL CARE PROVISIONS AND EMERGENCIES.
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 10/31/18 thru 11/5/18. Interviews were conducted with staff; observations were made; and documentation was reviewed relating to allegations of supervision, ratio, emergencies, safety, food, and physical plant. The evidence gathered during the investigation supports allegations, so the complaint is determined to be valid. Please contact me if you need further assistance. Thank you.
Standard #: 22VAC40-185-340-F Complaint related: Yes Description: Based on interviews with staff the facility failed to maintain complaince with this standard as required relating to supervision of the children. Evidence: Staff interviews confirmed that staff members had left the classroom to use the rest room, get the vacuum, get the laundry, and get a pacifier, without having another staff step into the room to supervise the children as required because there were no extra staff to step in. This occurred on 9/30/18 in infant room #1, and the toddler room. This also occurred on 10/15/2018 in the toddler room. The children in both rooms, on both days, were left unsupervised during this period of time. Plan of Correction: These staff were written up, and one was terminated. Staff have since been reminded of their responsibilities of the supervision and care of the children. Administrative staff are working to add staff to the center through hiring and securing subs so that they can have enough staff to allow for needed brief breaks to use the rest room, and do other job related tasks.
Standard #: 22VAC40-185-350-C Complaint related: Yes Description: Based on staff interviews the facility failed to maintain compliance with this standard as required relating to ratios in the mornings and in the 2 year old classroom. Evidence: Staff interviews confirmed that in the mornings on most days of each week, from 7:15-8am for at least the last month, the ratios are not maintained as required for the mixed age grouping of the children in building #1, the younger aged building. The issues with ratio are usually with the toddler room and 2's room. Staff interviews confirmed that on 11/5/18, both buildings were out of ratio from 7:15am-10am. Building #1 had 13 two year olds with only 1 staff. The ratio required for the 2 year old class was 1 staff to 5 children, as a child who was not 2 was in the classroom at that time. Also, beginning on 11/5/2018 a toddler, who is not yet 2 years old, was moved into the 2 year old classroom (#1) with out the proper documentation to do so. This changed the ratio from 1 staff to 8 children to 1 staff to 5 children, meaning the class room was operating out of compliance. During the inspection on 11-7-18 this child was in the classroom as well; there was one staff with 7 children which was non-compliant with the ratio of 1 staff to 5 children. The same situation was witnessed during the inspection on 11-7-18 in the other 2 year old classroom, where another child who wasn't 2 was in the class room without the proper documentation of move up. That classroom had 7 children with 1 staff, which was also non-compliant with the ratio of 1 staff to 5 children. Plan of Correction: More staff are currently being interviewed and hired. Administration will send subs to help out when needed for ratios, and schedules will be adjusted to accommodate for the morning ratios. Appropriate move up documentation will be obtained so that ratios are met in these classroom now and in the future.
Standard #: 22VAC40-185-350-E-4 Complaint related: Yes Description: Based on staff interviews the facility failed to maintain compliance with this standard as required relating to ratios in the mornings. Evidence: Staff interviews confirmed that on 11/5/18, both buildings were out of ratio from 7:15am-10am. Building #2 had 26 preschool aged children (3y-5y) with only 2 staff. The required ratio is 1 staff to 10 children. Plan of Correction: More staff are currently being interviewed and hired. Administration will send subs to help out when needed for ratios, and schedules will be adjusted to accommodate for the morning ratios.
Standard #: 22VAC40-185-350-F Complaint related: Yes Description: Based on review of documentation and staff interviews the facility failed to maintain compliance with this standard as required relating to moving up of children. Evidence: There were 2 children who were moved up into the 2 year old classes, prior to turning 2, without the proper assessment and documentation. Also, interviews with staff confirmed that children are often shuffled from the toddler room to the 2 year old room, and vice-versa to meet ratio compliance daily. This is not compliant with the standard of moving a child temporarily due to an unforeseen incident, or immediate need for an emergency. This is being done daily, which is disruptive to the child's schedule and is not providing consistency of routine and familiarity for the children. Plan of Correction: Proper documentation will be obtained for these 2 children, and any others who may be moving up early in the future. Children will be within their assigned classroom moving forward, unless an emergency situation occurs and it will only bee temporary until the situation is resolved.
Standard #: 22VAC40-185-550-D Complaint related: Yes Description: Based on review of documentation the facility failed to maintain compliance with this standard as required relating to emergency drills. Evidence: There had been no recorded practiced emergency escape drills for September or October 2018. These are required to be conducted and documented monthly. Plan of Correction: Drills will be conducted and recorded monthly moving forward.
