Technical Assistance:
Technical assistance was provided in the following areas of the standards: 22 VAC 40-185-70 (staff records), 22 VAC 40-185-190 (program director qualifications) and 22 VAC 40-185-210 (program leader qualifications).

Comments:
An unannounced monitoring inspection was conducted on 2/15/19 from 9:35am until 12:30pm. At the time of the inspection, there were 38 children in care with 11 staff present. A sample of 5 children's records and 9 staff records were reviewed. Children were observed participating in morning learning activities and playing outside on the playground. Restroom and hand washing procedures were also observed. Medication, first aid and emergency supplies, the emergency preparedness plan, documentation of emergency practice drills, children's injury reports and center postings were reviewed. Two violations in the areas of administration and background checks are identified on the violation notice and were discussed with the center owner during the exit interview.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on record review and interview, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance. Evidence: 1. The record for child 1 (date of enrollment: 5/24/18) contains documentation of a physical examination dated 10/20/18, which is more than one month after attendance. 2. The center owner confirmed that the record for child 1 contains documentation of a physical examination conducted more than one month after the child's attendance at the center.

Plan of Correction: The center owner stated that documentation of a physical was obtained at enrollment for child 1 but had accidentally been thrown away when the updated physical was provided to the center. New administrative staff have been hired and have been trained on proper record keeping procedures.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview, the center did not ensure that the results of the fingerprint based criminal history records check is obtained before an employee's first day of employment. Evidence: 1. Staff 1 has a documented hire date of 9/10/18. The results of the fingerprint based criminal background check for staff 1 was not obtained until 9/11/18. 2. The center owner confirmed that staff 1 began employment prior to obtaining the results of the fingerprint based criminal background check.

Plan of Correction: Going forward, the center owner will ensure that the results of the fingerprint based criminal background checks for potential new employees are received by the center before they are eligible for employment. New staff will not begin employment until those results are received.
