Comments:
A self reported incident involving the mishandling of one child was investigated on 01/30/2019. Observation of the center's video recording of 01/28/2019, a review of staff/child records and written statements was made and both staff and parent interviews were conducted. Violations:
Standard #: 22VAC40-185-400-B
Description: Based on the center's video recording, staff written statements and staff interviews, staff failed to provide behavioral guidance that was constructive in nature. Evidence: 1. On 1/28/2018, Staff #1 did not provide constructive behavioral guidance, but instead required Child #1 to sit in a chair for approximately 8 minutes, physically restricting the child?s movement and preventing the child from getting up. Staff #1 placed Child #1 in a child-sized chair and pushed the chair up close to the table. Staff #1 then squatted down behind the chair, placed an arm on either side of the child, underneath the child?s arms, and gripped the table, preventing the child from moving the chair or getting up. The child kicked and screamed while attempting to move from this position. 2. According to a written statement from Staff #2, "[Child #1] was crying and screaming while the teacher was holding onto [Child #1], [Child #1} started to kick the teacher on [their] legs. I asked [Staff #1] if [they] wanted me to take [Child #1] out of the class[Staff #1] said no and continued to hold onto [Child #1]."

Plan of Correction: On Monday, February 18, 2019 Staff received training on Behavioral Management during transitions, Center management system, mandated reporting and effective teaching strategies. Also, in contact with outside behavioral guidance trainer, will expect to have training on self-regulation and preventing power struggles to be completed by March 30, 2019. Trainings will be documented through sign-in log.

Standard #: 22VAC40-185-410-1
Description: Based on the center's video recording, staff written statements, and staff interviews, staff used forbidden actions with a child by forcing a child to assume an uncomfortable position. Evidence: 1. Staff #1 picked Chld #1 (age 4) up from circle time by wrapping their arms around the torso of Child #1 and lifting them up off the ground then carried Child #1 to a nearby table and placed Child #1 in a child-sized chair. 2. On 1/28/2018, Staff #1 required Child #1 to sit in a chair for approximately 8 minutes, physically restricting the child?s movement and preventing the child from getting up. Staff #1 placed Child #1 in a child-sized chair and pushed the chair up close to the table. Staff #1 then squatted down behind the chair, placed an arm on either side of the child, underneath the child?s arms, and gripped the table, preventing the child from moving the chair or getting up. The child kicked and screamed while attempting to move from this position. 3. Child #1 was observed crying, kicking and turning to attempt to free themselves from the chair and from Staff #1. 4. Staff #1 required Child #1 to remain in this position for approximately 8 minutes.

Plan of Correction: Retrain/train staff on Forbidden Actions to be completed by February 22, 2019. Each classroom will be physically observed as well as monitored via camera weekly to ensure no forbidden actions are occurring. An administrative member will complete the observation and a log will be kept of what class is being observed with time and date.
