The licensing inspector completed an inspection in response to a complaint regarding food being served, staff qualifications, illness of a child and staff interactions. The Department was notified on 01/22/19. The licensing inspector was on site at the center on 01/25/19 from approximately 9:45 AM until 10:45 AM, on 01/30/19 from approximately 9:20 AM to 10:45 AM and 02/11/19 from approximately 12:00 PM to 12:25 PM. During the inspection, interviews with staff were completed, documentation was reviewed and classroom observations were conducted. The preponderance of the evidence gathered during the investigation supports a portion of the allegation and therefore the complaint regarding staff qualifications is determined valid. See the violation notice for additional details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from date of receipt. You will need to specify how the deficient practice will be or has been corrected. Just writing the word 'corrected' is not acceptable. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Standard #: 22VAC40-185-340-D Complaint related: Yes Description: Based on review of staff files, documentation review and staff interviews, the center did not ensure at least one staff member who meets the qualifications of program leader or program director is regularly present in each grouping of children during the required times.
During the inspections, the licensing inspector interviewed a total of nine current and previous staff members and the following was determined:
1. A staff member stated that frequently in the Preschool classroom, Staff #1 was alone with the Preschool children in the afternoons with up to 10 Preschool children.
2. Staff #1 stated that she would be alone with the Preschool children from times varying in the afternoons prior to January 2019.
3. The Child Supervision Record (CSR) indicated Staff #1was alone with the Preschool children on 12/11/18, 12/12/18, 12/14/18, 12/17/18, 12/18/18, and 12/19/18 in the afternoons.
4. Staff #2 stated she thought because a lead qualified teacher was in the classroom next door and the walls are half walls, that Staff #1 was still considered to be under sight and sound supervision.
5. The record for Staff #1 indicated Staff #1 did not have the required education to be qualified as a program leader.
In each grouping of children at least one staff member who meets the qualifications of a program leader or program director is required to be regularly present with the exception of the first and last hour of operation when a center operates more than six hours per day and during the designated rest period.
Plan of Correction: The Center Director and Assistant Director have reviewed qualifications and adjusted schedules to ensure that only staff members who meet the qualifications of Program Leader or Program Director are regularly present with each group of children during the required times, exempting the first and last hours of the day and during nap/rest times. Staff and management have been made aware that the half walls separating classrooms do not allow staff members who do not meet those qualifications to be considered under sight and sound.
