22VAC40-185 STAFFING AND SUPERVISION.
The Licensing Inspector conducted a complaint an unannounced inspection on 3/5/19 in response to a complaint that was received in the Licensing office on 3/5/19 concerning the facility not maintaining the required staff-to-child ratios. Observations were conducted, staff were interviewed, and documentation was reviewed during the investigation. Based on the information gathered during the investigation, the evidence supports the complaint and is deemed to be valid. The area of non-compliance associated with the complaint is on the attached violation notice.
Standard #: 22VAC40-185-350-E-2 Complaint related: No Description: Based on observation, interviews and a review of documentation, it was determined that the licensee did not ensure that whenever children are in care ages 16 months to two years old, a ratio of one staff member for every five children is maintained. Evidence: 1. The Licensing Inspectors observed 14 children and two staff present in the Green (Two year old) classroom. Child #1 (23 months old) was present in the classroom. 2. Staff #1 (Program Director) confirmed that the proper staff-to-child ratio for child #1 was not being maintained. Plan of Correction: The facility responded: I have spoken to Mom about the situation and she did write a letter agreeing that the older class is a great place for her son. However I am very aware of the ratio. Whenever the younger team has an opening (often these days due to illnesses) we move child #1 down to the Red 2 class. If there is not an opening in Red 2 we attempt to move children from Green 1 to Green 2. If that is not an option then the Assistant Director will go into the Green 1 class as the 3rd teacher. We will continue to monitor all class rooms to ensure ratios are meet throughout the center.
