Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on March 28, 2019 regarding allegations of inappropriate behavior guidance. The inspection was completed on April 4, 2019 from 10:45am to 12:40pm, and April 11, 2019 12:15pm to 12:40pm. Interviews with staff were completed, observations were made in the center, documentation was reviewed, as well as video footage. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details. Complaint related: Yes
Description: Based on staff interviews on 04/04/2019, the center did not ensure that staff interact with a child to provide needed help, comfort, and support. EVIDENCE: 1. Staff #6 stated that when a child has been hurt Staff #1 has said " Well, you shouldn't have be there" and "That's what you get". 2. Staff #7 stated that when a child is crying Staff #1 will raise voice and yell "Quiet!" at the child

Plan of Correction: Immediate, individual training in Behavioral Guidance and Forbidden Actions of specified teacher. Review training at next staff meeting for all employees. 400-A In order to promote the child?s physical, intellectual, emotional and social well-being and growth, staff shall interact with the child and one another to provide needed help, comfort and support. ? Use consistency in applying expectations. ? Use kind words, positive in nature in a calm, nurturing, reassuring tone and voice level with out sarcasm.

Complaint related: Yes
Description: Based on staff interview on 04/04/2019, the center did not ensure that behavioral guidance shall be constructive in nature, and shall be intended to redirect children to appropriate behavior. EVIDENCE: 1. Staff #4 stated that during meal time she observed Staff #1 put the children's food in the trash if a child turned over their plate. 2. Staff #6 stated that during meal time she observed Staff #1 state "If they don't pick up their food that is their problem". 3. Staff #5 stated that she observed Staff #1 bring a crying baby into her classroom, state that the baby had been crying all day and then leave the child on the floor of the room. 4. Staff #6 stated that she observed Staff #1 tell a child to "shut up!"

Plan of Correction: Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. ? Use consistency in applying expectations. ? Use kind words, positive in nature in a calm, nurturing, reassuring tone and voice level with out sarcasm.

Description: Based on staff interview on 04/04/2019, the center did not ensure that roughly handling a child was forbidden. EVIDENCE: 1. Staff #4 stated that she observed Staff #1 place babies in their crib so hard they would loose their balance. 2. Staff #6 stated that she has observed Staff #1set the babies down "pretty hard". 3. Staff # 5 stated that she observed Staff #1 put a baby on the floor forcefully.

Plan of Correction: Forbidden Actions: ? Physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or typing, forcing a child to assume an uncomfortable position, or exercise as punishment. o Handle children with caution and care. ? Verbal remarks which are demeaning to a child are forbidden. o Use kind words, positive in nature in a calm, nurturing, reassuring tone and voice level with out sarcasm.
