Comments:
6/28/19- The Violation Notice was amended as a result of a first step review.
An unannounced inspection was completed on May 3, 2019 from approximately 10:00a.m. to 12:00p.m. in response to a complaint received on April 10, 2019 regarding staffing and supervision, forbidden actions and nutrition and food services. The investigation was initiated and completed on May 3, 2019. Staff, children, classrooms and the outside area were observed, staff was interviewed and children's records were reviewed as related to the complaint. The Director/Owner was available for the inspection and was present for the exit interview at which time the inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee. The complaint is determined to be valid for staffing and supervision and not valid for forbidden actions and nutrition and food services. Description: Based on observation and interviews, the licensee failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group.
Evidence: 1. During the inspection, Staff #1 was observed leaving a classroom of seven children, ages sixteen months through two years old, multiple times to include once to take a soiled diaper outside, for under five minutes each time, leaving Staff #2 alone when the applicable ratio was 1:5. When interviewed, Staff #1 and Staff #2 indicated this is the approximate number and group of children enrolled in this classroom daily, although there are days when not all children attend.
2. Upon arrival, Staff #3 was observed in a classroom of nine children, ages two through three years old, when the applicable ratio was 1:8. When interviewed, Staff #3 and Staff #1 indicated that Child #1, two years old, attends the center and is in this classroom regularly every other week for three to four days.
3. During the inspection, Staff #4 was observed to leave a classroom of six children, three through four years old, for approximately five minutes, leaving Staff #3 to supervise her own classroom of seven children, two through three years old, and this classroom, when the applicable ratio was 1:8.
4. In an interview, Staff #1 indicated that Staff #1, Staff #2, Staff #3 and Staff #4 are the only current, regular staff and acknowledged these classrooms were out of ratio when a staff needed to leave a classroom. Staff #1 also indicated that children of mixed ages are routinely combined to address ratios when needed.

Description: Based on observation the licensee failed to ensure that no child shall be allowed to drink or eat while walking around. Evidence: 1. Children, ages sixteen months through four years old, were observed outside on the playground. Several children were served graham crackers, while outside on the playground, without being required to sit down while eating. 2. Staff#1 acknowledged the children were served snack while continuing to play.

Complaint related: No
Description: Based on observation, the licensee failed to ensure that when a child is placed in an infant seat or high chair, the protective belt shall be fastened securely. Evidence: 1. A child, approximately sixteen months old, was observed in a high chair and the protective belt was not fastened. 2. Staff #1 acknowledged the belt was not fastened.
