Comments:
An investigation was initiated on 4/11/2019 in response to a complaint received in the licensing office on 4/4/2019. The investigation was conducted with the local agency and included interviews with staff and family members, review of documentation and record reviews. The complainant alleged that an employee physically punished a child in care. Evidence gathered determined the allegation to be valid. Violations cited can be found on the violation notice. The results of the investigation were discussed with the facility administrator via telephone on 5/31/2019.

Description: Based upon interviews, the facility did not ensure that physical punishment of children by staff is forbidden. Evidence: 1. On 4/3/2019, staff 2, bus driver, and staff 1, bus aide, were on the facility bus taking the children home from the facility. In interviews, staff 2, staff 3 and staff 4 all verified when child 1, age 5 years, boarded the facility bus to be taken home on 4/3/2019, child 1 did not have any marks on her face and was not crying. 2. Staff 2 and two additional witnesses stated that when child 1 got off the bus at her home, she was crying and had a mark on her right cheek. 3. Photographs taken on 4/3/2019 showed a raised red mark on the right cheek of child 1. 4. Staff 2 stated that staff 1 told her that she had slapped child 1 because child 1 had been telling other children about inappropriate behavior between child 1 and staff 1's son at the home of staff 1.

Plan of Correction: The facility responded with the following: Staff will continue to have Child Abuse and Neglect training annually during pre-service (local DSS). Staff will be trained during pre-service on standards of conduct and zero tolerance for any violations. All new employees will receive child abuse and neglect training. Discuss mandated reporters. Staff will receive Child Abuse and Neglect training thru out the school term.

Description: Based upon interviews, the facility did not ensure that staff do not make verbal remarks that are demeaning to the child. Evidence: 1. Interviews with staff 2 and an additional witness revealed that on 4/3/2019, as child 1 was exiting the facility bus at her home, staff 1 was heard calling child 1 a "expletive". 2. Staff 1 admitted to calling the mother of child 1 a "expletive" in the presence of child 1 outside of the child's home. 3. Staff 1 admitted that while riding the bus on the trip to take child 1 home, she raised her voice with child 1 and threatened child 1 that she was going to tell the child's parent of her behavior. 4. Staff 1 stated that she told child 1 that her behavior was "nasty".

Plan of Correction: The facility responded with the following: Report the incident. Suspend staff until investigation is complete. Meet with staff immediately to review standards of conduct and acceptable staff behavior. We will have monthly staffings to discuss appropriate language with children and adults. Staff termination as a result of valid finding.
