63.2 Child Abuse & Neglect
The Licensing Inspector conducted an unannounced inspection on 5/1/19 and 5/3/19 in response to a complaint that was received in the Licensing office on 4/26/19 concerning supervision of the children and reporting procedures. Observations were conducted, staff were interviewed, and documentation was reviewed during the investigation. Based on the information gathered during the investigation, the evidence supports the complaint and is deemed to be valid. The area of non-compliance associated with the complaint is on the attached violation notice.
Standard #: 22VAC40-185-80-B Complaint related: Yes Description: Based on interviews and a review of documentation, it was determined that the licensee did not ensure that the center shall inform the commissioner's representative as soon as practicable but not to exceed one working day of the circumstances surrounding any suspected incident of child abuse shall be reported in accordance with ? 63.2-1509 of the Code of Virginia. Evidence: 1. The Licensing Inspector received a complaint on 4/26/19 about an alleged incident at the facility that was reported to the staff on 1/16/19 by the parent of child #2. 2. During interviews, all staff were asked if they had contacted the local agency about the alleged incident , and all staff stated that they had not contacted the local agency. 3. The local agency, once informed about the alleged incident, did take the case to investigate. Plan of Correction: The facility responded: As of this date, June 24, 2019, we have reviewed the attached violation notice, and we have already taken steps to ensure that reporting to CPS occur within hours of receiving a complaint. The following action will be taken: Periodic training of all faculty and staff regarding what the law requires as a mandated reporter. The requirement for timely reporting, even if the allegations are questionable, will be stressed. Training will also include identifying child abuse and neglect, speaking to children about alleged abuse if applicable, documentation required for reporting, and the protocol for reporting. A training log will be created and maintained. Because school is not presently in session and students are on summer break, our next training session will be scheduled for the week of August 19, 2019.
