Comments:
The licensing inspector conducted an unannounced inspection on Tuesday, July 30, 2019, in response to a self-reported incident that the Department received on July 18, 2019 regarding inadequate supervision. The inspector was on site at the center on July 30, 2019 from 10:10am to 3:30pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The inspector completed additional interviews on August 6, 2019. The preponderance of the evidence gathered during the investigation validates the self-reported incident of inadequate supervision. Violations were cited regarding supervision and center policies. See the violation notice for more details. Standard #: 22VAC40-185-40-E
Description: Based on documentation review and interviews, the center did not maintain compliance with their own policies and procedures required by standards. Evidence: The center's policies and procedures regarding supervision were not followed on July 16, 2019 when Teacher #1 and Teacher #2 did not have 4-year old, child #1, within sight and sound supervision and discovered that the child was locked in the restroom alone. The center?s policies and procedures for supervision of children states that "All individual and or groups of children must be supervised at all times while in our care", "Children must not be left alone or unsupervised in classrooms, hallways, offices, lobbies, bathrooms, playgrounds, or vehicles.", and "Closely monitor bathrooms when used by more than one child at a time. Be aware of children entering and exiting restrooms. Children should not use restrooms or toilet stalls in groups, nor should they linger in restroom areas for more than a few minutes." These policies and procedures were not followed during the above described incident on July 16, 2019.

Plan of Correction: All staff will be retrained on KCE policies on supervision and transitions. - Management will continue to monitor and work with the preschool bathroom routine to ensure we are complying with all regulations. - We have partnered in inclusion services to support the individual child?s needs - Management will complete observation of bathroom routines and help teachers make any adjustments necessary - Administrative actions will be taken if any staff continue to not follow our supervision standards - District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed District Leader and Corporate Team Commitments - District Leader will make sure any new management is trained CSR and supervision practices - Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure that a implementation of classroom management activities are taking place.

Description: Based on observation and interviews, the center did not ensure staff ensure the care, protection and guidance of all children when supervising children. Evidence: 1. In an interview, Teacher #1 reported that on July 16, 2019, she locked the preschool bathroom door inside the classroom using an external lock on the door in order to keep a child from entering the restroom to play. Teacher #1 reported that she did not check the restroom prior to locking the door to ensure that the restroom was empty. Within two minutes after locking the door, Teacher #1 found 4-year old, Child #1, inside the restroom alone when the child had not been observed in the classroom during a check of the Child Supervision Records.

Plan of Correction: All staff will be retrained on KCE policies on supervision and transitions. - Management will continue to monitor and work with the preschool bathroom routine to ensure we are complying with all regulations. Management made the decision to part ways with this teacher - Any new incoming staff or current staff filling in will go over the Positive Guidance standards - Management will use Professional Development Day to have a positive guidance training with all staff members - Observations will be completed in the classroom to ensure that our positive guidance practices are in place - Work orders will be placed to have a technician come evaluate the restroom doors and any other alternatives we can use - Teachers and Center management will review the licensing standards regarding supervision within sight and sound District Leader and Corporate Team Commitments District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed - District Leader will make sure any new management is trained CSR and supervision practices - Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure that a implementation of classroom management activities are taking place.

Standard #: 22VAC40-185-340-F
Description: Based on observation and interviews, the center did not ensure that children under 10 years of age were always within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom. Evidence: 1. While taking attendance on July 16, 2019, Teacher #2 noticed that 4-year old, child #1, was not visible in the classroom. Teacher #2 then asked Teacher #1 if child #1 had left with a parent. Teacher #1 immediately went to the restroom, located in the classroom, and unlocked and opened the restroom door. Teacher #1 immediately saw child #1 standing in the restroom. Teacher #1 picked child #1 up and took the child back into the center area of the classroom where the other children were playing. Teacher #2 noticed one tear on child #1's face. 2. Both Teacher #1 and Teacher #2 stated that they did not see child #1 enter the restroom, and they were not aware of the child's location until Teacher #1 went to unlock the restroom door. 3. Teacher #1 stated, earlier all of the children in the classroom woke up from nap, had snack, washed their hands, and went to play in centers. At some point after the children went to play in centers, Teacher #1 went to lock the restroom door. Teacher #1 and Teacher #2 both stated that they were not sure how long child #1 was in the restroom before the door was locked. Teacher #1 stated that the restroom door was locked to prevent another child from going into the restroom to play, and the door had been locked for approximately 2 minutes before it was unlocked by Teacher #1.

Plan of Correction: All staff will be retrained on KCE policies on supervision and transitions. - Management will continue to monitor and work with the preschool bathroom routine to ensure we are complying with all regulations. - Additional resources will be given to staff to help with classroom management and systems to support supervision in older age groups. - Management will continue to have conversations with staff around the importance of compliance and supervision safety. - All new staff coming in will observe supervision and transition activities in classrooms prior to being in ratio District Leader and Corporate Team Commitments - District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed - District Leader will make sure any new management is trained CSR and supervision practices - Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure that a implementation of classroom management activities are taking place.
