Comments:
An unannounced complaint investigation was completed on 10/7/19 in response to a complaint received by the licensing office on 8/30/19. On 10/7/19 inspector investigated the complaint at the center relating to the allegation regarding building maintenance, and staff to children ratios. The information gathered during the investigation supports the allegation, so the complaint is determined to be "valid". Violations were found in the areas of supervision of children, and building maintenance. Additional violations were cited in the area of behavioral guidance. Description: Based on observation it was determined the center did not ensure that all areas and equipment of the center, inside and outside, were maintained in a clean, safe and operable condition. Evidence: 1. In the 1 year old room there was a hole in the wooden door to the kitchen that had rough splintered edges accessible to children in care. 2. In the 3 year old room there was peeling paint, peeling/broken plaster on the walls, and a hole in the wooden door to the storage closet that has rough splintered edges accessible to children in care. 3. In the 4 year old room there was peeling paint on the wall accessible to children in care. 4. In the school age room there was peeling paint, wallpaper, and drywall on the walls of the class and bathroom accessible to the children in care.

Description: Based on observation and interview the center did not ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99. Evidence: 1. On the outdoor playground there was no resilient surfacing in the fall zones of the 4 swings and 2 Little Tikes Slides. 2. Staff #1(Director) stated that they "forgot to schedule the delivery of the mulch".

Complaint related: Yes
Description: Based on observation it was determined the center did not ensure that there was one staff member for every eight two year old children. Evidence: 1. At 4:09pm-4:20pm there was 1 staff member with 9 two year old children. 2. Staff #1(Director) confirmed that the two year old class was out of ratio during this time.

Description: Based on observation and interview it was determined the center did not ensure that behavioral guidance was constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. Evidence: 1. Inspector overheard staff #2 say "no" in a loud voice tone. 2. Inspector observed a child in the 2 year old class sitting in the corner looking down to the floor. Inspector inquired why the child was sitting in the corner staff #2 stated that the child was "in time out because they keep taking their shoes off after I put them back on". 3. Staff #1(Director) confirmed that the child should not have been in time out for removing their shoes. 3. Inspector did not observe the staff try to redirect the child's behavior.
