63.2(17) License & Registration Procedures

Comments:
An unannounced non-mandated inspection, a Conditional License requirement, was completed on 10/22/2019. There were 25 children, ages 4 months-4 years, and 9 staff members present during the inspection. The inspector reviewed 5 children's records, 5 staff member records and the background checks for an additional 5 staff members' during the inspection. The staff stated that medication is not currently being administered. Children were observed in the following activities: participating in free choice activities and during lunch. The inspector reviewed the emergency supplies during the inspection. The inspector discussed the storage of cleaning materials, over-the-counter skin products and nutrition with the staff. The inspector arrived for the inspection at 10:20 a.m. and departed at 1:15 p.m. If you have any questions, please contact Becky Forestier at 540-309-2835.

Violations:
Standard #: 22VAC40-185-280-G
Description: Based on observations and discussion with the staff, the facility failed to ensure that if hazardous substances are not kept in original containers, the substitute containers shall clearly indicate their contents.


Evidence:
1. There was a clear plastic spray bottle in the storage room off of the kitchen that contained a pink liquid solution and was not labeled to clearly indicate the contents. Staff #11 confirmed that the solution was a cleaning solution.
2. There was a clear plastic spray bottles in the Infant Room that contained a liquid solution and was not labeled to clearly indicate the contents. Staff #6 stated that the liquid solution was OdoBan.

Plan of Correction: Labels will be placed on the bottles.

Standard #: 22VAC40-185-560-G
Description: Based on observations and discussion with the staff, the facility failed to ensure that when food is brought from home the food container shall be clearly dated and labeled in a way that identifies the owner.

Evidence: There was a pink Nuk bottle in the Toddler Room that was not dated or labeled to clearly identify the owner. Staff confirmed that the bottle was brought in from home that morning.

Plan of Correction: Staff will be more observant and will empty containers and place them in the child's cubbie when emptied. Staff will label and date food from home.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review and discussion with the staff, the facility failed to obtain a central registry finding within 30 days of employment.

Evidence:
1. The record for Staff #5 did not contain central registry findings; the documented date of hire for Staff #5 was 09/18/2019.
2. The record for Staff #10 did not contain central registry findings; the documented date of hire for Staff #10 was 09/06/2019.

Plan of Correction: The program director will follow-up within 25 days when findings are not received.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and discussion with staff, the facility failed to obtain a copy of the results of a search of the central registry maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him.

Evidence: The record for Staff #5 contained documentation that Staff #5 had resided outside of the state of Virginia in the preceding five years. A search of the central registry or equivalent registry maintained by that state had not been requested nor obtained.

Plan of Correction: A request will be sent to that state.
