63.2(17) License & Registration Procedures

Comments:
The Licensing Inspector conducted an inspection on 9/27/19 and 10/2/19 in response to a self-report made by the center on 7/25/19 regarding an injury to a child. Interviews with staff were conducted and documentation and records related to the incident were reviewed. The investigation was concluded on 10/21/19. Violations cited as a result of the investigation are identified on the violation notice and were discussed with the center director on 11/1/19.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on record review and interview, the center did not ensure that staff records shall contain all the required information.

Evidence:
1. The record for staff 2 (hire date: 6/19/19) contains documentation of only one reference as to character and reputation as well as competency, where two are required.
2. Administrative staff confirmed that the record for staff 2 is lacking one of the two required reference checks.

Plan of Correction: The center responded with the following: Director will record and verify all new hire documentation is placed in new hire file.

Standard #: 22VAC40-185-550-M
Description: Based on interview and documentation review, the center did not ensure that a written record of children's serious and minor injuries are maintained.

Evidence:
Child 1 sustained an injury to her elbow during a field trip on 7/23/19; however, there was no written documentation regarding the incident available for review during the inspection.

Plan of Correction: The center responded with the following: Director will verify all incidents are documented as well as placed in a secure binder for easy retrieval.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center did not ensure that staff who have lived outside of the state of Virginia within the past 5 years obtain a central registry check from that state.

Evidence:
1. Staff 1 has a hire date of 2/2/18. Staff 1 indicated on her sworn statement or affirmation that she has resided in the state of South Carolina within the past five years. There is no documentation that a request for an out of state central registry check was sent to South Carolina for staff 1.
2. Administrative staff confirmed that an out of state central registry check was not requested for staff 1.

Plan of Correction: The center responded with the following: Director will request out of state documentation for all employees who have lived outside of Virginia during day 1 orientation. Director will record and verify on new employee staff file.
