Today we discussed the clear groupings of children in the supervision of specified staff and sight and sound supervision of children as they transition from one area of the program to another and as they travel to and from the restrooms.
The program should have a clear distinction of young children enrolled in the licensed program versus older children whose attendance is not in the licensed program. Each staff should know specifically which children they are in their care and be aware of the ratios of adults to children for the children attending the licensed program.
No child day center may hire for compensated employment, continue to employ, or permit to serve as a volunteer who will be alone with, in control of, or supervising children any person who (i) has been convicted of any barrier crime as defined in ? 19.2-392.02 or (ii) is the subject of a founded complaint of child abuse or neglect within or outside the Commonwealth. All applicants for employment, employees, applicants to serve as volunteers, and volunteers shall undergo a background check in accordance with subsection B prior to employment or beginning to serve as a volunteer and every five years thereafter.
Please send documentation that background check violations have been corrected within 10 days of the inspection.
Corrections can be documented with scanned and emailed documentation, or may be faxed, or delivered in person to the Licensing Office. Mail delivery may be utilized ?at your own risk? if the correction is made in a timely manner allowing adequate time for mail to ARRIVE in the licensing office within the 10 day period.

An unannounced monitoring Inspection was conducted on 12/15/19 from 3:00 p.m. to 5:30 p.m.
The records sample size consisted of 5 children?s records. Nine (all) staff records for this site were reviewed at the administrative offices on 12/18/19.
At the time of arrival, there were 29 children, ages 11 to 14 years old with 2 staff in the game room and 9 children 13 to 18 years old with 2 staff in the cafeteria. Younger children began arriving at 4:00 p.m.
Children were observed arriving to the program in groups transported by bus, playing video games, cards and board games, socializing and eating an afternoon snack.
Violations were found during inspection and are identified on the violation notice.

Standard #: 22VAC40-185-60-A Description: Based on a review of records, the licensee did not ensure that each enrolled child record contained all required information to include the name, address, and phone number of two designated people to call in an emergency if a parent cannot be reached and the child's first date of attendance.
Five children's records were reviewed during the inspection on 12/13/2019.
The record for child #3 and child #5 did not contain documentation of their first dates of attendance.
The record for child #5 did not contain the address for either of the two designated emergency contacts.
Staff #1 stated that he did not see this information in the records at the time of inspection.
Plan of Correction: Staff #1 stated that he would obtain this information and document it child #3 and child #5's records by the end of next week
Standard #: 63.2(17)-1720.1-A Description: Based on a review of records, the licensed center continued to employ a person whose background check indicates that they have been convicted of any barrier crime as defined in ? 19.2-392.02 within or outside the Commonwealth.
Nine (all) staff records for the licensed program operating at John F. Kennedy Middle school were reviewed at the administrative offices on 12/18/19.
The record for staff #4, whose date of employment was documented as 6/15/04, contained the most recent Federal Background report dated 8/23/18 with results stating that the staff is "Not eligible as an employee".
The administrative staff #10 stated that staff #4 is currently employed as a staff working with children in the licensed program.
Plan of Correction: The administrative staff stated that the program is closing for the holiday and that she will ensure that staff #4 will no longer be employed as staff in the licensed program when the program resumes in January 2020.
