Comments:
The licensing inspector conducted an unannounced complaint inspection with another local agency in response to a complaint that was received by the licensing department on October 10, 2019 regarding the center?s physical plant. The inspection was initiated on November 06, 2019 and completed on December 10, 2019. On November 06, 2019, the inspector was on site from 12:48pm to 2:25pm. On December 05, 2019, the inspector was on site from 2:39pm to 5:54pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The inspector completed an additional interview on December 10, 2019.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Description: Based on observation, the center did not ensure that areas and equipment of the center were maintained in a clean, safe and operable condition.
Evidence:
The inspector observed several areas of the center with chipped and peeling paint within the reach of children in care. The following was observed:
1. On 11/06/2019 and 12/05/2019 the Yellow Birds cubby room had several white paint chips on the floor. On 11/06/2019, the inspector observed several children?s coats, jackets, and backpacks being stored in the cubby room. Children were also observed going in the room to get their belongings. On 12/05/2019, the inspector observed cots being stored over the space on the floor where the paint chips were located.
2. On 11/06/2019 and 12/05/2019, the Baby Birds 1 room had a window sill with chipped and peeling paint. Most of the base of the window sill was covered with the chipped and peeling paint. On 12/05/2019, the inspector observed an infant crib positioned directly against the wall and window sill where the chipped and peeling paint was located. The teacher informed the inspector that the crib was assigned to an infant in care and used frequently by the infant. The teacher also informed the inspector that the crib was not repositioned while the crib is in use.
3. On 11/06/2019 and 12/05/2019, the Baby Birds 2 classroom had baseboards and window sills with chipped and peeling paint. On 11/06/2019 and 12/05/2019, Infant cribs were positioned against the window sills within the reach of children in care. On 12/05/2019, the inspector observed a crib occupied by an older infant positioned against a baseboard with peeling paint. The baseboard was within the reach of the child.
4. On 11/06/2019 and 12/05/2019, the chickadees classroom had a window sill with chipped and peeling paint within the reach of children in care. On 11/06/2019, the inspector observed paint peeling and hanging from a window sill. The window sill was accessible to children in care. On 12/05/2019, the inspector observed tables and chairs positioned against the window sill.
5. All throughout the building, on 11/06/2019 and 12/05/2019, specifically on door moldings, baseboards and window sills, were areas of chipped and peeling paint within the reach of children in care.

Complaint related: Yes
Description: Based on observation and interviews, the center did not ensure when staff are supervising children, they always ensure their care, protection, and guidance.
Evidence:
1. On 12/05/2019, the inspector, two representatives from the Virginia Department of Health (VDH), and a center representative toured the center. The VDH representative pointed out several areas of the center where lead paint was present and compromised due to chipping and peeling. Several areas were within the reach of children in care.
2. On 12/05/2019, the VDH representative reminded the center?s representatives that the center was informed in June of 2019 that there were numerous painted surfaces inside and outside of the center that contained lead paint hazards.
3. The center did not meet lead code compliance in June of 2019 and was given a deadline of 10/25/2019 to come into compliance. As of 12/05/2019, the VDH representative informed the inspector that the center was not in lead code compliance.
4. The VDH representative informed the inspector that they suspect high potential for public health threat.
5. Center Representative #1 informed the inspector and both VDH representatives that they have always known that lead paint was in the building.
6. The inspector observed stuffed animals, toys, supplies on and against areas where lead paint was identified.
7. Interviews with four center staff revealed the following: a. As of 12/05/2019, the center staff was not informed of any areas inside of the center containing lead based paint. b. Children are around areas with dust and chipped and peeling paint. c. As of 12/05/2019, the center staff was not informed of interim lead exposure strategies that could help with the prevention of children receiving lead poisoning. d. Children have been seen peeling paint off of baseboards during nap time.
