Technical Assistance:
We discussed the requirements for staff records, background checks and posting information near the entrance to the licensed program. The risk assessments for violations were provided.

We reviewed the requirement of having a qualified lead supervisor with each grouping during implementation of the care and activities such as in the gym. Also, we talked about emergency drill practice requirements.

Comments:
3/6/2020 - The inspection report was amended as a result of a first step review.

Thank you for your assistance during today's unannounced monitoring inspection conducted from 11:49 AM to 4:50 PM. Today, five preschool age children were present with five staff. It was reported that as many as nine children attended this morning, including school age. Up to seven children attended during the afternoon, ages toddler through school age, with four to five staff. I viewed program activities, staffing, supervision, interactions with children, equipment, daily routines, posted information, insurance, lunch/snacks, agency inspection reports, implementation of procedures for accounting for children's whereabouts, emergency supplies and drill records, injury records, five records for children, seven records for staff, staff qualifications, staff training, indoor and outdoor areas. The toddlers now have a separate playground area at the fenced playground. We talked about having components of the large playground structure off limits when the mulched area is frozen. A locking system is in use at the gate to the swimming pool area. Today, the children enjoyed a variety of age appropriate toys and materials. Active play opportunities were offered in the downstairs gym. Transitions were appropriately supervised. The staff were observed providing frequent interactions with the children.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on a review of seven records for staff, and interviews with administrative staff, the center failed to include all required information for the records of two staff. (Repeat Violation.) Evidence: There was only one reference documented in the record of staff member 4. Staff confirmed that at least two or more references as to character, reputation and competency and before the employment of staff member when two additional references did not respond to requested information. The documented employment date for staff member 4 was December 26, 2019. In addition, staff member 1 began work as a lead supervisor September 18, 2019. The record did not include all completed training (minimum twenty-four hours) for child development, recognizing and reporting child abuse and neglect, and playground safety that was needed to demonstrate compliance with position qualification requirements.

Plan of Correction: The assigned administrative staff will obtain at least one additional reference for staff member 4. If needed contact information for a different potential reference from staff member 4 and obtain a second reference. Administrative staff will make sure all required references are obtained for new employees. The program director will obtain any certificates for the completed training by staff member 1 and add these as well as any training conducted by the program staff. The program director will make sure all documented training for qualification requirements as a lead supervisor are maintained in the staff records.

Standard #: 22VAC40-191-60-C-2
Description: Based on a review of seven records for staff, and interviews with administrative staff, the center failed to obtain a Virginia central registry finding for one staff member within thirty days of initial employment. Evidence: Staff member 3 began employment on December 6, 2019. Staff confirmed that the request for the Virginia central registry finding was sent to Richmond on December 8, 2019. The results of the central registry finding was not in the record for staff member 3. Administrative staff confirmed that when the requested report was sent within seven calendar days but was not returned within 30 calendar days, the requester did not contact the agency in Richmond within four working days as required to inquire about the processing of the request.

Plan of Correction: Administrative staff who oversees the background check requests immediately sent an email to the agency in Richmond to inquire about the requested Virginia central registry finding for staff member 3. When received, a copy of the finding will be sent to the licensing inspector as well as viewed and filed as required. In the future, the assigned staff will track all dates of requests and make sure the agency is contacted if the request is not received within thirty days. All communication about inquiries will be maintained in staff files.

Standard #: 22VAC40-80-120-E-5
Description: Based on observation of the posted information, and an interview with administrative staff, the center failed to post all required information in a prominent place at the public entrance of the licensed facility. Evidence: The notice of the commissioner's intent to take action, dated September 30, 2019, was sent to the Boars Head Sports Club by certified mail on October 8, 2019. The Notice of Intent was not seen at the entrance of the licensed facility to advise consumers of intermediate sanctions for serious violations. An administrative staff person indicated that the Notice of Intent was upstairs on an office desk.

Plan of Correction: The program director posted the Notice of Intent in view above the cubbies at the entrance area of the Kid's Club where the license has been prominently posted. The notice will remain posted using the time frames provided by the Division of Licensing.

Standard #: 22VAC40-80-120-E-6
Description: Based on observation of the posted information, and an interview with administrative staff, the center failed to post all required information in a prominent place at the public entrance of the facility. Evidence: The special order was not seen posted in a prominent place at each public entrance of the licensed premises to advise consumers of serious violations. The special order was entered by the Virginia Department of Social Services on November 14, 2019 and sent by certified mail to Boars Head Sports Club on November 15, 2019. An administrative staff person indicated that the "Special Order" was upstairs on an office desk.

Plan of Correction: The program director posted the "Special Order" in view above the cubbies at the entrance area of the Kid's Club near the posted license. The notice will remain posted in view using the time frames provided by the Division of Licensing.
