63.2 Child Abuse & Neglect

Technical Assistance:
Provided consultation on:
1. All staff are mandated reporters and the legal requirements for reporting suspected child abuse as required by ? 63.2-1509 of the Code of Virginia and,
2. Confidential treatment of personal information about children in care and their families
3. Staff shall interact with the child and one another to provide needed help, comfort and support

Comments:
An unannounced monitoring inspection was conducted on 01/15/2020 and 1/31/2020, in conjunction with the local department of social services, to investigate a self-reported incident regarding a forbidden action. Provider interviews were conducted, documentation and photos were reviewed and classroom observations were made. One violation was issued as a result of this inspection. Violations:
Standard #: 22VAC40-185-80-B
Description: Based on staff interviews and review of documentation, the facility failed to report a suspected incident of child abuse to Child Protective Services (CPS) in accordance with the Code of Virginia 63.2-1509. Evidence: At approximately 1:50 pm on 1/8/2020 staff #1 wrote up an observation form stating child #1 (age 3) had scratches/pinch marks on their arm and back. At approximately 2:00 pm, staff #1 called staff #2, who called administrator #1 into the classroom to observe the marks on child #1. Administrator #1 told staff #2 to take a picture of the child?s arm. On 1/9/2020, the child?s parent confronted staff regarding the marks on the child?s arm, requesting that the child be moved to a class with a different teacher. After the concern was brought to staff, the incident was not reported to CPS until 1/15/2020, after the LI advised them to do so. The local agency, once informed about the alleged incident, did take the case to investigate.

Plan of Correction: We spoke with all teachers and made sure they knew that everyone here was a mandated reporter. We also will be including information on reporting child abuse to CPS in our training packets for our professional development day on 2/17/2020.
