Comments:
An unannounced monitoring inspection was conducted today from 2:30pm - 5:00pm. There were 61 children in care ages two and half years through ten years old with six teachers. Children and staff records were reviewed. Required postings, annual inspections, emergency evacuation drills, first aid kit and medication were reviewed. A walking of the center inside and outside was completed. Children were observed engaged in teacher and self-directed activities including restroom routines, transitions hand washing, snack, and inside and outside play activities. Violations regarding supervision and ratio, background checks, terms of the license, physical plant and nutrition were identified and appear on the violation notice. The violations were discussed with the owner at the conclusion of the inspection.

Description: Based on observation the center failed to ensure that areas and equipment are maintained in safe operable condition.
Evidence:
1 - In the four year old classroom there is peeling paint within reach of children.
2 - There is broken toilet paper dispenser in hallway nearest to the preschool classroom.
3 - In the two-three year old room there is peeling paint on the wall and door frames within reach of children in care.
4 - Additionally in the two-three year old room there is a cracked outlet face. The crack is large enough for a young child's fingers to be stuck into the open space.
5 - Also in the two-three year old room there is missing flashing along the bottom of the wall within reach of children.
6 - The over-sized gate leading from the parking lot to the playground is bent and disrepair. The bent metal is within reach of children in care.
a. Staff 1 stated that the gate had been hit by another vehicle.

Description: Based on observation when supervising children, the center failed to demonstrate care and protection.
Evidence:
1 - At approximately 3:30pm two children arrived to the center, having been transported by public schools, child 5 and child 6 ages 8 and 9 years old were observed as they exited the school bus, walked across the center parking lot, up the center stairs and waited outside the locked center door until a staff noticed the two standing there and opened the door.
a. Staff present in the school age room were unaware when the children arrived.

Standard #: 22VAC40-185-350-A
Description: Based on observation the center failed to demonstrate that staff are counted in the required staff-to-children ratios only when they are directly supervising children.
Evidence:
1 - From approximately 2:45pm through 3:45pm there were 20 - 31 children present in the school age room ranging in age from 5 to 10 years old with one staff.
a. Additionally, staff were intermittently present in the school age classroom as they moved in and out of the classroom to attend to other responsibilities including but not limited to greeting children outside the center as they exited public school and center provided transportation, to get snacks and to assist and supervise children in the restroom.

Description: Based on observation and interview the center failed to demonstrate compliance when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group will apply to the entire group.
Evidence:
1 - Approximately 2pm there were nine children in a group with one staff, staff 3. The ages and number of the children present in the group required an additional staff.
a. Staff 3 stated that the children ranged in age from two and half years to three years old.

Description: Based on observation the center failed to demonstrate that meals and snacks served follow the most recent, age-appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA).
Evidence:
1 - The snack served to children today was one half to a whole frosted cupcake.
2 - The posted menu called for vanilla or chocolate cupcakes and apple juice.
2 - Staff 2 confirmed that the cupcakes were the planned snack for that day.

Standard #: 22VAC40-185-560-K
Description: Based on observation the center failed to demonstrate that tables are sanitized before and after each use for feeding.
1 - After children finished eating snack they immediately began playing with table top toys and doing homework. The tables were not sanitized once the children finished eating snack on them.
2 - Additionally, child 7 arrived late and was served snack on the table that children were playing on. The table was not sanitized prior to child being served, nor was the table sanitized after the child finished eating.

Description: Based on record review and interview the center failed to demonstrate employees are not employed until the person?s completed sworn statement or affirmation.
Evidence:
1 - The record for staff 4 does not contain documentation of a sworn statement or affirmation.
a. Staff 4 has a documented date of employment as January 2, 2020.
2 - Staff 1 confirmed that the record for staff 4 does not contain a sworn statement or affirmation.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review and interview the center failed to ensure that employees have a central registry finding within 30 days of employment.
Evidence:
1 - The record for staff 4 does not contain documentation of a central registry finding.
a. Staff 4 has a documented date of hire has January 2, 2020.
b. There is not any documentation in the record of staff 4 that central registry finding was requested within the allotted seven days.
2 - Staff 1 confirmed that there is not any documentation that the central registry finding was request. The finding is not present in the record of staff 4.

Standard #: 22VAC40-80-120-A-6
Description: Based on record review, observation and interview the center failed to demonstrate that the terms of the license are followed during hours of operation.
Evidence:
1 - During record review it was determined that four children enrolled in the program were present for care prior to being 30 months old as the terms of license state the age range to be two years, six month old through ten years old.
a. Child 1 has a documented first date of attendance as September 3, 2019 and documented date of birth as April 19, 2017. Therefore, child 1 was present for care at 29 months one month prior to being 30 months old.
b. Child 2 has a documented first date of attendance as September 18, 2019 and a documented date of birth as July 30, 2017 . Therefore child 2 was present for care at 26 months of age, four months prior to being 30 months old.
c. Child 3 has a documented first date of attendance as October 7, 2019 and a documented date of birth as June 10, 2017. Therefore child 3 was present for care at 27 months, three months prior to being 30 months old.
d. Child 4 has a documented first date of attendance as August 23, 2019 and a documented date of birth as July 1, 2017. Therefore child 4 was present for care at 25 months, five months prior to being 30 months old.
