63.2(17) License & Registration Procedures

Comments:
An unannounced monitoring inspection was conducted on 12/3/18 from 9:30 am until 11:30 am to review the religious exempt requirements. At the time of the inspection nine children were present with one staff. The sample size consisted of five children's records and three staff's records. Children and staff were observed during an educational lesson, art project related to the educational lesson, clean-up, hand washing, transitions, and behavioral guidance. Violations were found during this inspection and are documented on the violation report. If you have questions or concerns contact the licensing inspector at (540) 292-5933 for further assistance.

Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to ensure staff signed sworn disclosure statements prior to the first day of employment. Evidence: 1. The records for three staff were reviewed. None of the records contained a signed sworn disclosure statement. 2. The principal verified no staff had completed a sworn disclosure statement.

Plan of Correction: All staff will sign a sworn disclousre statement. This will now be included in paperwork completed prior to the start of the school year.

Description: Based on interview, the center failed to ensure upon beginning work every staff is certified by a practicing physician or physician assistant to be free from any disability which would prevent him/her from caring for children under his/her supervision.

Evidence:

1. Three staff records were reviewed. Two did not contain documentation of a staff health report.
- staff 2 - start date 8/18
- staff 3 - start date fall 2014 when the preschool opened
2. The principal stated the two staff are not full-time teachers in the classroom but do assist with the children. The principal verified they do not have staff health reports for the two staff.

Plan of Correction: Staff will complete required health reports prior to beginning of school each year per facility handbook. For present staff, required health reports will be completed by 12/10/18 this year.

Description: Based on a review of the parent handbook and interview, the center failed to provide a written disclosure to parents and guardians of the children in the center and the general public that included the following: enrollment capacity, food service, health requirements for staff, and public liability insurance. Evidence: 1. The director provided all documents given to parents. None of the documents contained information regarding these areas. 2. The director verified they do not provide parents with this information in writing.

Plan of Correction: This was corrected and sent home to parents on 12/3/18 and will be included in the handbook going forward.

Standard #: 63.2(17)-1716-B-3
Description: Based on a review of the policies and procedures and interview, the center failed to establish and implement a procedure for a daily simple health screening and exclusion of sick children by a person trained to perform such screenings. Evidence: 1. The center's written policies and procedures do not include daily simple health screening by a person trained to conduct the screenings for any staff. 2. The principal stated they do not have a policy regarding daily simple health screening by a person trained to conduct the screenings for any staff and no staff have been trained in daily simple health screening.

Plan of Correction: All staff will view the video provided by DSS regarding daily simple health screenings on Monday, December 10, 2018. Staff will include this information in the handbook and implement the screening starting on Tuesday, December 11, 2018.

Description: Based on record review and interview, the center failed to ensure staff hired after 1/22/18 had a fingerprint-based criminal history check determination letter prior to the first day of employment, and that staff hired before 1/22/18 obtained a fingerprint-based criminal history check determination letter by 9/30/18.

Evidence:

1. One of the three staff records reviewed did not have a fingerprint background check completed prior to the first day of employment.
- staff 2 - start date 8/18 - no fingerprints completed.
2. One of the three staff records reviewed did not have a fingerprint background check completed by 9/30/18.
- staff 3 - start date fall 2014 (when preschool opened) - no fingerprints completed.
3. The principal stated neither staff 2 or staff 3 have obtained the required fingerprint background checks.

Plan of Correction: Staff 2 and 3 will have fingerprint-based criminal history check determination letter completed.
