Comments:
An unannounced monitoring inspection was conducted on 7/1/19 at St. Mark Lutheran Church of Charlottesville from 11:15 am until 1:35 pm to review the religious exempt requirements. At the time of the inspection 43 children were present with nine staff. The sample size consisted of five children's records and five staff's records. Children and staff were observed during free outdoor play, water play, an art activity, lunch, bathroom break, hand washing, transitions and behavioral management. Violations were found during this inspection and are documented on the violation notice.

Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to ensure all staff completed a sworn disclosure statement prior to the first day of employment and a central registry record check within 30 days of employment. Evidence: 1. The record for staff 1, start date 8/3/18, has a central registry record check dated 9/18/18. 2. The record for staff 4, start date 4/9/18, has a sworn disclosure statement dated 4/23/18 and does not have a central registry record check. 3. The director verified the dates and is unaware of what happened with the central registry record check for staff 4.

Plan of Correction: The central registry document for staff 4 will be mailed by 7/3/19. The licensing office will be notified when the results are received. Central registry searches will always be completed within the first 30 days of employment in the future. Sworn statements will always be obtained prior to the first day of employment in the future.

Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letter prior to first day of employment for one out of five staff. Evidence: 1. The record for staff 1, start date 8/3/18, has a fingerprint-based criminal history check determination letter dated 8/13/18. 2. The director verified staff 1 started employment prior to receipt of the fingerprint-based criminal history check determination letter.

Plan of Correction: Fingerprint searches will always be completed before staff are employed in the future.
