22VAC40-191 Background Checks for Child Welfare Agencies

An unannounced focused monitoring inspection to review areas of non-compliance from the last inspection as a part of the provisional license period. There was one child present with the provider. The point total as two. The provider was expecting to pick up four children from school. No children's records were reviewed as there were no new children in care. The inspector arrived at the provider's home at 1:45 pm and departed at 3:15 pm. There was detailed discussion about the fingerprinting process and the schedule for the provider and household members to have it completed based on the date of the last completed Criminal Record check.

Description: REPEAT VIOLATION Based on record review and interview with the provider, the provider failed to ensure that when a person in the home becomes 18 years old that a Criminal Record Check (CRC) was completed. Evidence: 1. The inspector noticed through review of records that a household member became 18 years old on April 12, 2017. The household member did not have a completed CRC. The provider showed the inspector the Criminal Record Check that was returned to her from the VA State Police for payment with a letter dated 1/25/18 by the VA State Police. The provider stated that payment was made when the first request for a CRC was sent to the VA State Police. The provider stated that she had sent a CRC in August after the violation was cited 5/30/17 to the VA State Police. The household member, according to the provider, left for college on August 27.

Plan of Correction: The provider will send the CRC back to the VA State police with a note that a money order was sent with the initial CRC form.
