22VAC40-191 Background Checks for Child Welfare Agencies
An unannounced monitoring inspection was completed on September 20, 2018 from approximately 1:45p.m. to 3:45p.m. Six children were in care, ages infant to four years old, for a total of nineteen points. The children were observed interacting with the provider and an assistant, during the end of nap time, hand washing and snack and free play times. Children?s toys, learning materials, equipment, bathroom, inside and outside play areas and the home?s first aid kit and emergency supplies were inspected. Five children?s records, two caregiver records, fire drill and shelter in place logs, daily attendance and required postings were reviewed. Transportation is not provided and medication is not administered. There were no injury reports to review. The provider was available for interview, inspection and exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee. There were six citations for violations of the Standards. See the violation notice on the Department's public web site for violations of the Standards.
Standard #: 22VAC40-111-750-A Description: Based on a review of records, the licensee failed to obtain annual written parent authorization for diaper ointment noting any adverse reactions for one or five children. Evidence: 1. Child #2 was enrolled on July 8, 2018. 2. In an interview, Caregiver #1 indicated that diaper ointment has been applied to Child #2. Child #2's record lacked written parent authorization for the product. 3. Caregiver #1 acknowledged this authorization has not been obtained. Plan of Correction: Provider will obtain written parent authorization noting any adverse reactions.
Standard #: 22VAC40-111-100-B Description: Based on a review of children?s records and interview, the licensee failed to obtain documentation of religious exemption for a physical examination from parent who objects on religious grounds for two of five children. Evidence: 1. Child #1 was enrolled on April 17, 2018 and Child #3 on March 5, 2018. 2. Neither Child #1 or Child #3?s record contained documentation of a physical. 3. Caregiver #1 indicated that Child #1 and Child #3 are religiously exempt from obtaining a physical and acknowledged that documentation from the parent was not obtained. Plan of Correction: Provider will obtain statements from parents.
Standard #: 22VAC40-111-120-A Description: Based on a review of caregiver records, the licensee failed to maintain a record for each caregiver for one of two caregivers. Evidence: 1. Caregiver #2 was hired on September 4, 2018. Caregiver #1 was unable to produce a record for Caregiver #2. 2. Caregiver #1 acknowledged there is no record for Caregiver #2 at this time. Plan of Correction: Provider will complete a record for Caregiver #2.
Standard #: 22VAC40-111-200-A Description: Based on a review of caregiver records, the licensee failed to provide orientation to caregiver by the end of their first week of assuming job responsibilities for one of two caregivers. Evidence: 1. Caregiver #2 was hired on September 4, 2018. 2. There was no documentation of any orientation prior to Caregiver 2?s first week of employment or before assuming job responsibilities. 3. Caregiver #1 acknowledged this orientation was not provided. Plan of Correction: Provider will provide Caregiver #2 orientation.
Standard #: 22VAC40-111-250-A Description: Based on observation, the licensee failed to ensure that hanging items, including but not limited to window blind cords shall be out of reach of children. Evidence: 1. Two window blind cords were observed hanging down in two different windows in a room accessible to and used by children, ages sixteen months to four years old. 2. Caregiver #2 acknowledged these cords were within reach of the children. Plan of Correction: Corrected on site. The blind cords were placed out of reach.
Standard #: 63.2-1721.1-B-2 Description: Based on review of caregiver records, the licensee failed to obtain a criminal history record check prior to employment for one of two caregivers. Evidence: 1. Caregiver #2 was hired on September 4, 2018. 2. Caregiver #2?s record lacked criminal record check findings. 2. Caregiver #1 acknowledged Caregiver #2 began employment prior to obtaining the results of a criminal history record check. Plan of Correction: Provider will not hire any staff without first obtaining a criminal record check.
