Technical Assistance:
The provider must send documentation to the LI that the background checks have been requested no later than 10 days following this notification dated April 30, 2019.

Comments:
An unannounced monitoring inspection was conducted today from 12:25pm-1:45pm. At the beginning of the inspection there were 7 children (18 points) directly supervised by 1 caregiver. The sole caregiver was not qualified, due to lack of training and background checks, to provide care to children by herself on the date of inspection and called the provider to return the the family day home after the inspector arrived. The provider and an additional caregiver arrived back to the family day home at 12:47pm and resumed care giving duties and coming back into compliance for supervision requirements. The home, 3 staff records, 5 children?s records, evacuation drills, emergency supplies, and policies were inspected. There were no medications on site today. Children were observed coloring at the table, and listening to stories and music as they rested on sleeping mats. An exit conference was held with the provider and a plan of correction is requested and should be emailed to the licensing inspector within the next five days. There was an abundant supply of books, toys, and materials for the children. The home was clean and organized. Areas of non-compliance are identified in the Violation Notice. Standard #: 22VAC40-111-150-D-1
Description: Based on record review, an assistant left alone with was not certified in cardiopulmonary resuscitation (CPR) on the date of inspection. Evidence: Adult 1 is not currently certified in CPR and was left alone to care for children today from approximately 12:25pm until 12:47pm.

Plan of Correction: Registered for the class of the day 5/4/19.

Standard #: 22VAC40-111-150-D-2
Description: Based on record review, an assistant left alone with was not certified in first aid from the American Red Cross, American Heart Association, American Safety and Health Institute, or National Safety Council, or current first aid certification issued within the past three years by a community college, a hospital, a rescue squad, or a fire department on the date of inspection. Evidence: Adult 1 is not currently certified in First Aid and was left alone to care for children today from approximately 12:25pm until 12:47pm.

Plan of Correction: Registered for the class of the day 5/4/19.

Standard #: 22VAC40-111-570-A
Description: Based on observation and record review, the provider did not ensure that a caregiver does not exceed 16 points using the following point system to determine if an additional caregiver is needed: Children from birth through 15 months of age count as four points each; Children from 16 months through 23 months of age count as three points each; Children from two through four years of age count as two points each. Children 5 through none count as one point each. Evidence: On the date of inspection Adult 1 was the sole provider for children in care from approximately 12:25pm until 12:47pm. There were 7 children in care during that time period totaling 17 points by age.

Standard #: 22VAC40-191-60-B
Description: Based on record review, the provider did not deny employment to a caregiver who had not completed a sworn statement or affirmation. Evidence: Adult 1 has not completed a sworn disclosure or affirmation and was working as a caregiver in the family day home on the date of inspection.

Plan of Correction: Completed same day.

Standard #: 63.2-1721.1-B-2
Description: Based on record review and provider statement, not all caregivers have submitted to a national criminal record check prior to the first date of employment. Evidence: Adult 1's record does not contain a national criminal record check. The provider stated that fingerprints have not yet been submitted. Adult 1 was working as a caregiver on the date on inspection.

Plan of Correction: Request for VA Department Services was submitted at the beginning of April for Adult 1. [sic] Submitted the form for finger prints for the day of 5/2/19.
