5/1/19 ? The Violation Notice was amended as a result of a first step review. The licensing inspector conducted an unannounced complaint inspection on January 31, 2019 in response to a complaint received by our department on January 30, 2019. The inspector was on site from 10:25 AM to 11:40 AM. Additional investigation activities and dates include phone interviews and record reviews on multiple dates between 1/30/19 and 3/1/19. The allegations of the complaint were attributes of household members, determining the need for an additional caregiver, unlocked ammunition, and unlocked medications. Observations were made in the home, interviews were conducted, and records were reviewed. The preponderance of the evidence gathered during the investigation supports one or more of the allegations and the complaint is determined valid. See the violation notice for more detail. Individuals 14 years of age and older who reside in the family day home are required to comply with submitting background checks within the mandated timeframes. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the licensing office within 5 business days. Your plan of correction should contain 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Standard #: 22VAC40-111-730-D
Complaint related: Yes
Description: Based on observation and interview, the provider did not ensure that medications shall be kept in a locked place using a safe locking method that prevents access by children. Evidence: 1. On 1/30/19 the licensing inspector spoke with an outside investigating agency who reported having observed unlocked medications in the home on this date. Medications were reported to be have been observed in a locked safe and unlocked in Provider #1's purse. The medications' labels indicated being prescribed to a person who was not a named resident of the home. 2. During an interview with the licensing inspector on 1/31/19, Provider #1 reported having prescription medication in her purse at that time. The licensing inspector observed the purse identified by Provider #1 as being located on the kitchen table, in an unlocked area, and within reach of the children in care. Provider #1 reported the medication bottle in her purse belongs to a relative of Household Member #1, and indicated the contents of the bottle did not match the prescription label. Provider #1 reported the bottle contained nasal decongestant, and stated it was not a controlled substance. Provider #1 indicated the medication was in her purse, but did not allow the licensing inspector to observe the medication. Provider #1 reported that all other household medication is stored unlocked in the upstairs bathroom. Provider #1 indicated the household medication which was stored upstairs were inaccessible to children due to the children in care not using the upstairs area of the home.

Plan of Correction: The provider states, "All prescription medication is in a locked box cabinet upstairs in my bathroom."

Complaint related: No
Description: Based on record review and interview, the provider did not ensure compliance with relevant federal, state, or local laws. Evidence: 1. The licensing inspector observed that the licensee's zoning permit does not authorize the licensee to employ a caregiver who is not a resident of the home. 2. During an interview with the licensing inspector, Provider #1 reported that Caregiver #1 is not a resident of the home. Provider #1 reported having no prior knowledge of the necessity of a zoning permit to employ a non-resident.

Plan of Correction: The provider states, "I am in the process of having a permit."

Complaint related: Yes
Description: Based on interview and observation, the provider did not ensure that ammunition shall be stored in a locked container, compartment, or cabinet during the family day home's hours of operation. Evidence: 1. On 1/30/19 the licensing inspector conducted an interview with an outside investigating agency. The outside agency reported observing unlocked ammunition in the upstairs bedroom closet. 2. On 1/31/19 the licensing inspector observed two boxes of ammunition and one gun clip with ammunition located in the master bedroom closet, on an upper shelf, stored in an unlocked area. 3. During an interview with the licensing inspector on 1/31/19, Provider #1 reported being unaware of the requirement to secure ammunition in a locked area when there is no gun reportedly in the home.

Plan of Correction: The provider states, "Ammunition is no longer in the home."

Complaint related: Yes
Description: Based on interview and record review, the provider did not ensure caregivers will not exceed 16 points. Evidence: 1. During an interview with the inspector on 1/31/19 Provider #1 stated there were 11 children in care, totaling 22 points, on 1/30/19. Provider #1 reported being the sole caregiver on 1/31/19 from approximately 10:00 AM to 10:15 AM. Provider #1 reported that Caregiver #1 was present in the home prior to 10:00 AM and returned at 10:15 AM, approximately. 2. The licensing inspector observed the attendance sheet for 1/30/19, listing 11 children in care, totalling 22 points. 3. An outside investigating agency reports observing 11 children in care with Provider #1 as the sole caregiver for "quite a while" on 1/30/19.

Plan of Correction: The provider reports, "My assistant went to the store to pick up material for the daycare. I was at 12 points by the time she came back I was over my number. I will make sure I have all materials needed before day begins."
