63.2 Child Abuse and Neglect

Comments:
A self-reported incident was investigated on July 10, 11, 16, and 31, 1014, regarding inappropriate discipline and forbidden actions.

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on interviews with staff, and a review of documentation, it was determined that the center failed to ensure the care and protection of children in care at the facility. Evidence: On three occasions, June 26, 2014, July 3, 2014 and July 8, 2014, staff observed Staff A using forbidden actions when disciplining at least four, three year old children. No Staff member intervened to protect the children nor communicated their observations of the use of forbidden actions to administration and/or Child Protective Services until July 10, 2014. Staff A was observed yelling at, spanking and yanking children by the arm as well as punishing a three year old child for a toileting accident. In a written statement, Staff A confirmed that on multiple occasions, she had spanked at least four, three year old children.

Plan of Correction: When the information was shared with management, Staff A was terminated immediately. Minnieland?s mission is to provide learning in a loving environment and the mistreating of children is not tolerated. The inappropriate handling of children (yanking, spanking, yelling) was not reported until the staff was questioned in regards to the sprinkler incident which was reported by two other teachers. The staff person that failed to report is no longer employed with us. A staff meeting was conducted on August 25th, during which there was a review of the mandated reporter responsibilities. All staff had previously been trained on reporting but they are currently re-taking the Child Abuse and Neglect Recognizing, Reporting, and Responding for Educators and will be complete by Sept. 26, 2014. An Attachment training will be conducted during the October staff meeting.

Description: Based on interviews with staff and a review of documentation, it was determined that on multiple dates, one staff used forbidden actions, which included physical punishment and rough handling of the children in care at the center. Evidence: Interviews with staff revealed that: On June 26, 2014, Staff A was observed yanking Child A (three years old) up by their arm, screaming in the child's face and then spanking the child. After Staff A spanked Child A, the child was observed crying and then being placed in a chair for time-out by Staff A. On July 8, 2014, Staff A was observed yanking Child C (three years old) up by the arm during naptime then taking them into the bathroom area and slapping the child on the arm/shoulder area. On July 8, 2014, three staff witnessed Staff A forcefully hold Child D (three years old) in the water sprinkler. Prior to the sprinkler activity, Child D stated to staff that they were frightened of the water and did not want to participate. Three staff heard Child D screaming in a high pitched voice tone as the child was being forced to stay under the sprinkler by staff A. Staff A was overheard saying, 'No, you are going to get wet.' Following the sprinkler activity, staff observed Staff A spank and hit child D twice on the back and legs as the child was changing clothes from the water play activity. Staff A confirmed to the Licensing Inspector (LI) during an interview and in a written statement that she had spanked multiple children who were in her care and supervision.

Description: Based on staff interviews and a review of documentation, it was determined that staff punished a child for a toileting accident. Evidence: On July 3, 2014, Child B (three years old)wet themselves during naptime, Staff A took the child into the bathroom then ordered the child to take the wet clothes off and Child B was spanked by Staff A.
