22VAC40-191 Background Checks (22VAC40-191)

The licensing inspector conducted an unannounced inspection in response to a self reported incident that was received by the licensing office on 10/09/2014. Interviews and a follow-up inspection were conducted with staff relating to allegations that 3 staff members had left a child unsupervised in a classroom for approximately 20 minutes. The information gathered during the investigation supports the allegations, so the incident is determined to be valid. Please complete the columns for ?description of action to be taken? and ?date to be corrected? for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 10 calendar days of receipt. Description: Based on observation, the facility failed to ensure that when staff are supervising children, they are always ensuring their care, protection and guidance. Evidence: Observed in surveillance video and confirmed through staff interviews that CH1 was left in the classroom, unsupervised for approximately 20 minutes, while the class went to the playground (that is located down the street) to play. Staff 1, 2 and 3 were not aware that CH1 was missing until approximately 1.5 hours later.

Plan of Correction: Staff involved in incident were terminated.

Description: Based on observation and staff interviews, the facility failed to ensure that all children under 10 years of age are always within actual sight and sound supervision of staff. Evidence: Observed in surveillance footage that Staff 1, 2 and 3 had left CH1 unsupervised in the classroom while they took the rest of the class to the playground down the street from the facility. CH1 was alone for approximately 20 minutes before being found by a fourth staff member that was walking down the hall and observed CH1 crying and alone in the classroom.

Plan of Correction: - Upon hire, staff complete orientation that includes training on proper procedures for supervising, tracking and transitioning children. Staff received refresher training regarding these procedures August 2014. - On 10/13/14 Administration held classroom team meeting to renew established procedures. - Staff received intensive professional development regarding Hopkins House specific procedures related to child safety including supervising, tracking and transitioning children on 10/23/14.

Description: Based on observation, staff members made contradictory statements to a representative of the commissioner. Evidence: 1) Identified through interviews with Staff 1 that Staff 1 had seen CH1 in the lobby and that CH1 was wearing a Spiderman hoodie and that Staff 1 had spoken to CH1 in the lobby of the building prior to heading out to the playground asking the child if they could see with their hoodie on. Staff 1 stated that they had conducted a count of children lined up prior to leaving the classroom and in the lobby, and that the child was with them at that time. The licensing inspector observed in the surveillance footage that CH1 was not wearing a Spiderman hoodie moments before, during or after the time of the incident and that CH1 had never made it to the lobby at the time of the incident. CH1 had been left behind in the classroom bathroom, and exited the bathroom and waited in the classroom unsupervised (approximately 20 minutes), until a 4th staff member walked past the classroom to find the child alone. 2) Identified through staff interviews that Staff 2 was walking with CH2 who had began to have a large emotional tantrum in the lobby and that the child was so unruly and out of control that Staff 2 was unable to properly assist in counting and supervising the children. The licensing inspector observed in surveillance footage that Staff 2 and CH2 were in the lobby with the rest of the class and that CH2 was walking very casually and under control as Staff 1 and Staff 2 conversed with a passing staff member. There was no tantrum in the hallway that would affect the proper assistance and supervision of children in care. 3) Identified through interviews with Staff 1 that Staff 1 used the attendance record on a clipboard to complete a face to name count of children in the lobby and that CH1 was observed to be with the group in the lobby. The licensing inspector observed in surveillance footage that CH1 had only left the classroom bathroom after the class left the building, and then waited alone in the classroom until a 4th staff member found the child.

Plan of Correction: Staff involved in incident were terminated.
