22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted from 10:50 a.m. to 1:30 p.m. At the time of entrance the following adult to child ratios were observed: 14 children, 4 to 5 years old, with 2 staff 8 children, 2 to 3 years old, with 2 staff 8 children, 3 to 4 years old, with 1 staff 13 children, 7 to 11 years old, with 1 staff 8 children, 16 to 24 months old, with 2 staff 6 children, 6 to 12 months old, with 2 staff The records sample size consisted of 4 children?s records and 4 staff records. Children were observed singing songs, being read to from children's literature, playing outdoors, participating in an Easter Egg hunt, eating lunch which consisted of Macaroni and cheese, corn, pineapple and milk, being held, rocked and bottle fed, and resting quietly on mats (or cribs) at nap time. Medication administration was not observed. However, 4 medications stored on site for emergency use were reviewed with regard to storage, labeling, written authorizations and required documentation. Incident and accident reports were reviewed for recent minor injuries incurred by children in care. Transportation was not observed and the vehicle used for transporting children to and from the center was not on site. However, the standards related to transportation and field trips were reviewed. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance. The licensee provided verbal responses to the violations during the inspection, which were entered on to the violation notice by the licensing inspector.
Standard #: 22VAC40-185-160-A Description: Based on a review of records and interview, the licensee did not ensure that each staff person submits documentation of a negative Tuberculosis screening within 21 days after employment. Evidence: The records for 3 recently hired staff were reviewed. Staff #2 who began employment 2/6/15 id not have results of a Tuberculosis screening in her record. Staff #3 who began employment 2/28/15 did not have results of a Tuberculosis screening in her record. When asked if documentation of a Tuberculosis screening had been obtained, the center administrator / owner stated that arrangements had already been made to obtain the screenings within the next week. Plan of Correction: Staff #2 is scheduled to get a Tuberculosis screening next week and staff #3 will obtain a Tuberculosis screening by the end of the current week. The owner / Administrator will follow up with new staff prior to 21 days of employment to ensure their Tuberculosis screening is conducted and results are placed in records.
Standard #: 22VAC40-185-280-B Description: Based on observation, the licensee did not ensure that hazardous substances are stored in a locked place using a locking method that prevents access by children. Evidence: An aerosol can of Spray Starch was located in a plastic stacking bin at a height of 2 feet from floor level in the two-year-old classroom. There were warnings listed on the label to include "Keep out of reach of children" and "inhaling contents can be fatal". 8 children, ages 2 to 3 years old were present in the classroom with one staff during the inspection. Plan of Correction: The can was removed from the classroom and relocated to a locked cabinet during the inspection. Staff stated that this was an oversight and that she will ensure that aerosol cans and items with warning labels will be kept in a locked location.
Standard #: 22VAC40-191-60-C-2 Description: Based on a review of records and interview, the licensee did not ensure that central registry findings for new staff are obtained within 30 days of employment at the center. Evidence: The records for 3 recently hired staff were reviewed. Staff #1 who was began employment 2/28/15 did not have results of a central registry search in her record. Staff #2 who began employment 2/6/15 id not have results of a central registry search in her record. Staff #3 who began employment 2/28/15 id not have results of a central registry search in her record. Copies of the request form were present in the records, but results had not been received back by the center. The center administrator / owner stated that she had not yet contacted the agency to inquire about the delayed reports. Plan of Correction: The center administrator / owner stated that she will contact the agency tomorrow morning and document / follow the instructions given to obtain the required documentation. Future requests will be followed up upon with the agency if results are not received within 30 days.
