Discussed the following standards: staff-to-children ratio requirements, definitions, an staffing/supervision.

Comments:
A complaint investigation was conducted on 06/01/2015 and 06/11/2015 in response to allegations received by our office regarding the administration of the center, supervision of children, staff-to-children ratio requirements, toileting procedures, and parental involvement, and forbidden actions. Based upon multiple staff interviews and documentation reviewed, the preponderance of evidence supports the following allegations: staff-to-children ratio requirements. The complaint is deemed to be valid. Another violation not related to the complaint was cited. Standard #: 22VAC40-185-290-3
Complaint related: No
Description: Based upon observations made, electrical outlets did not have protective covers. Evidence: 1) One electrical outlet was missing one of the two required protective covers in the Preschool A classroom by the 'Spiders on the Web' board. 2) One electrical outlet was missing one of the two required protective covers in the Preschool B classroom by the library and language shelf. 3) One electrical outlet was missing two of the two required protective covers in the Discovery Preschool classroom by the diapering table.

Plan of Correction: All electrical outlets will have protective covers.

Description: Based upon multiple staff interviews and documentation reviewed, when children were regularly in ongoing mixed aged groups, the staff-to-children ratio applicable to the youngest child in the group was not applied to the entire group. Evidence: 1) Multiple staff interviews confirmed that on a regular basis the Preschool A, Preschool B, Pre-Kindergarten, and School Age classrooms are combined between the hours of 6:30am to approximately 8:00-8:30am. During this time, there were 2 two years old present (Child A and Child B), and the staff-to-children ratio was not adjusted to one staff member for every eight children. Additionally, multiple staff interviews confirmed that regularly the staff-to-children ratio they were following was one staff member for every 10 children. 2) Multiple staff interviews confirmed that on a regular basis children from the Pre-Kindergarten classroom are moved to the School Age classroom at approximately 5:00pm. During the time these children were in the School Age classroom, the staff-to-children ratio followed was one staff member for every 18 children, and not adjusted to one staff member for ever 10 children as these children did not meet the school age definition as found on page 1 of the standards for licensed child day centers (Child C, D, E, F, and G). 3) Documentation reviewed (Child Supervision Record) confirmed that on 05/18/2015 at 5:10pm, Child C, H, I, and J were transition to the School Age (SA) classroom; on 05/19/2015 between 5:00pm-5:06pm, Child C, D, and F were transition to the SA classroom; on 05/20/2015 at 5:00pm, Child C, G, H, and I were transition to the SA classroom; on 05/21/2015 at 5:00pm, Child E and K were transition to the SA classroom; and on 05/22/2015 at 5:10pm, Child C, D, K, and L were transition to the SA classroom. Documentation (Child Supervision Record) dated 05/26/2015-05/29/2015 also confirmed Pre-K children who do not meet the school age definition were transition to the SA classroom around 5:00pm. Additionally, multiple staff interviews confirmed that staff-to-children ratio requirements were not adjusted to one staff member for every 10 children.

Plan of Correction: The staff to children ratio applicable to the youngest child will be applied to the entire group at all times.

Complaint related: Yes
Description: Based upon documentation reviewed, ratio requirements of one staff for every eight children was not met for two-year-old children. Evidence: Documentation reviewed (Child Supervision Record) confirmed that on 05/18/2015, ten children, including Child A; 2 years old, and Child B; 2 years old, were under the supervision of Staff A from 6:56am to 7:10am, exceeding the required one staff member for every eight children by 2. At approximately 7:10am, a second staff (Staff B) came in the classroom. On 05/19/2015, Staff A was directly supervising 9 children from 7:00am-7:05am, when Staff B came into the classroom. Child A; 2 year old was in attendance starting at 6:56am.

Plan of Correction: One staff to every 8 children will be met for two year old children.

Complaint related: Yes
Description: Based upon documentation reviewed, ratio requirements of one staff for every ten children was not met for Pre-K children. Evidence: Documentation reviewed (Child Supervision Record) dated 05/21/2015 confirmed that at 4:58pm, 14 children were under the supervision of Staff A; exceeding the required ratio by 4 children until approximately 5:25pm.

Plan of Correction: One staff to every 10 children will be met for all Pre-k children.
