22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitor inspection was conducted on 7/29/2015. There were a total of seventy-nine (79) children ages 4 months ?12 years old. Records for recently hired staff members were reviewed. Areas of non-compliance found during the previous inspection were reviewed. Most violations have been corrected however there was one repeat violation. Children were observed during arrival/departure procedures, active/quiet activities, meals/snacks, hand washing/diapering/bathroom procedures and rest/nap period. Risk Assessment and areas of non compliance found during the inspection were reviewed with the Center Director on 7/29/2015.
Standard #: 22VAC40-185-270-A Description: Based on inspection, the Licensee failed to ensure areas and equipment of the center are maintained in a clean, sage and operable condition. EVIDENCE: 1. On the school age playground LI Anderson observed exposed tarp underneath resilient surfacing (mulch) surrounding the covered picnic table. Exposed tarp creating a tripping hazard. 2. On the school age playground, LI Anderson observed a open painters ladder standing beside the storage shed accessible to the children in care. Plan of Correction: Mulch will be added/raked to cover exposed tarp. Painter ladder will be removed & stored in the outdoor storage shed.
Standard #: 22VAC40-185-350-E-5 Description: Based on observations & discussion with staff, the Licensee failed to maintain required adult to child ratios in each group. EVIDENCE: In the school age classroom, there were 20 children ages 6-12 years old under the direct supervision of 1 staff member. Ratios should be 1 staff member per 18 children. Plan of Correction: Director will reduce ratios in the school age room.
Standard #: 22VAC40-185-500-B Description: Based on inspection, the Licensee failed to have diaper disposable system that is either foot operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal. EVIDENCE: The foot-operated trash can used to dispose pull-ups was inoperable. The foot pedal on the trash can located in the & boys bath room did not lift the lid when stepped on. Plan of Correction: Director will replace trash can
Standard #: 22VAC40-191-60-C-1 Description: Based on record review, the Licensee failed to obtain Background Checks (criminal history record) within 30 days of employment. EVIDENCE: 1. Background Check (criminal history record) has not been completed for Staff #2. Hire date for staff #2 is 6/01/2015. 2. Background Check (criminal history record) has not been completed for Staff #1. Hire date for staff #1 is 6/22/2015. Plan of Correction: Staff will be released from day care until background checks are completed

EVIDENCE: 1. Background Check (central registry) has not been completed for Staff #2. Staff #2 date of hire was 6/01/2015. 2. Background Check (central registry) has not been completed for Staff #1. Staff #1 date of hire was 6/22/2015. Plan of Correction: Staff will be release from day care until background checks are completed.
