An unannounced other inspection was done today August 4, 2015 by a licensing inspector. This inspection was in response to two separate incident reports received by the center director. The first report received July 10, 2015, was that a teacher in the four year old classroom popped the buttocks of a four year old child. The second report received July 28, 2015, was that another teacher swatted the hand of a 13 month old child who was reaching for an open container from the classroom refrigerator. The licensing inspector interviewed staff who witnessed the separate incidents. It was determined from the information obtained from the staff interviews that both incidents were valid and in violation of the licensing standards. Description: Based on observation forbidden actions were used with the children in care on two separate occasions. Evidence: 1. During the inspection for the first center reported incident, based on information obtained through interviews with staff #'s 1-4, it was determined that staff # 5 was witnessed popping child # 1- age 4 years, two to three times on his buttocks. Also, from information obtained through the interviews, staff # 5 was witnessed immediately after the popping incident placing child # 1 in a sitting position against the wall in a rough manner. Through the interviews with the same staff it was determined that child # 1 was not physically harmed. 2. During the inspection for the second center reported incident, based on information obtained through interviews with staff # 1 & 6, it was determined that staff # 7 smacked the hand of child # 2, age 13 months. Through the interviews with the same staff it was determined that child # 2 was not physically harmed. 3. It is noted that the LI was informed by the director that in earlier interviews staff #'s 5 & 7 both indicated to the director that the reported incidents were correct.

Plan of Correction: All staff are made aware of acceptable and non acceptable forms of discipline and are required to sign a document stating they understand the policies. Staff were not allowed with the children until the investigation was finished. Staff were terminated upon validation of reports. A center wide staff meeting was called discussing topics included were: 1.) licensing standards reviewed 2. reiteration of discipline policy 3. parent permission does not override the center policy ( this was discussed as staff # 5 had been given permission to pop the child's buttocks. The child is a family friend of staff # 5) and 4. responsibility to report incorrect actions.
