22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted from 10:30 a.m.-12:30 p.m. with three staff. 25 children, ranging in age from 16 months through 6 years, were in the care of three staff. Children were observed having outdoor play, washing hands, eating packed lunches from home, playing in the Montessori centers, and preparing for rest time. Three staff records were reviewed. Six children's records were reviewed and in compliance. Both the fire and health inspections are current. The last fire drill was 11/4/15. Standard #: 22VAC40-185-70-A Description: Based on review of three staff records, the center did not maintain complete staff records. Evidence: Staff A's (hired 5/2015) record did not include name, address, job title, emergency contact, one reference, level of education, date of hire, and work history. Staff B's record did not include date of hire, name, address, job title, emergency contact, two or more references, level of education, and work history. Staff C's (hired 8/2013) record did not include name, address, job title, emergency contact, two or more references, level of education, and work history. Plan of Correction: Job applications are now all included in staff files with the required information.
Standard #: 22VAC40-185-80-A Description: Based on review of written classroom attendance records, the center did not maintain an accurate written record of children in attendance. Evidence: On 11/16/15, there were two children marked as present on the written attendance record in the toddler classroom. However, there were five toddlers physically present on the playground. Plan of Correction: Classroom Attendance sheets have been modified.
Standard #: 22VAC40-185-240-D-5 Description: Based on review of three staff records, the center did not have at least one staff member on duty that had obtained daily health observation instruction within the last three years. Evidence: There was no documentation available onsite that any staff member had daily health observation instruction within the last three years. Plan of Correction: Staff C is currently enrolled to complete Daily Health Observation Instruction. Other staff members will also enroll to complete this certification.
Standard #: 22VAC40-185-340-C Description: Based on observation and review of three staff records, the center did not have a staff member who is program director qualified or program leader qualified on the premises during the hours of operation when one or more children are present. Evidence: On the morning of November 16, 2015, 25 children were in care of Staff A, Staff B, and Staff C during the time of the inspection. There was no documentation available to the licensing inspector that any of these staff are program leader qualified or program director qualified. Plan of Correction: Staff B is certainly qualified and all her education background is currently in the staff binder.
Standard #: 22VAC40-185-340-F Description: Based on observation, it was determined that children under 10 years of age were not always in sight and sound supervision of staff. Evidence: During the inspection, the licensing inspector observed two children exiting through the back French doors onto the back deck, where no staff was present, to hang wet towels onto the drying rack and children using the bathrooms and cleaning up materials like the pink letters in the primary classroom area while both staff were on the porch and outdoor area. Plan of Correction: Drying rack has been moved inside. Children may only go on the porch with an adult.
Standard #: 22VAC40-185-350-C Description: Based on observation, staff interviews, and review of five children's records, the center did not maintain the required supervision ratio of staff-to-children. Evidence: Two staff, Staff B and Staff C, were supervising twenty children in the primary Montessori classroom. The required ratio of one staff member for every eight children, based on the youngest child in the group, Child A, age two, applies to the entire group. Plan of Correction: We have a 2nd volunteer in the Toddler room. All 2 yr. olds have returned to the toddler room when space is available. When necessary a third adult volunteer comes into the primary classroom.
Standard #: 22VAC40-191-60-C-1 Description: Based on review of three staff records, the center did not have an original criminal history record report within 30 days of employment of a staff member. Staff B's record did not have documentation of an original criminal history record report. Plan of Correction: Staff B may not return to work until an original criminal history record report with satisfactory findings is received.
Staff B's date of employment as on her Documentation of orientation for new employees is Nov. 6th 2015. She is still within the 30 days. Her Criminal History is currently in the binder. Central Registry forms have been submitted and are expected to arrive the last week of November or the first week of December.
Standard #: 22VAC40-191-60-C-2 Description: Based on review of three staff records, the center did not have an original criminal history record report within 30 days of employment of a staff member. Staff A's (hired 5/2015) and Staff B's records did not have documentation of an original central registry (CPS) record check. Plan of Correction: Staff A and Staff B may not return to work until original central registry record checks with satisfactory findings is received.
Central Registry Records are currently on file for Staff A.
