22VAC40-191 Background Checks (22VAC40-191)

An unannounced complaint inspection was conducted on 2/16/2016 regarding an allegation that the facility was not in compliance with the following areas of child day center standards: physical plant, supervision, programs and special care provisions and emergencies. Based on the information gathered the complaint is found to be not valid in all areas except injury documentation. An additional violation was found in the area of staff to child ratios. Please complete the "plan of correction" for each violation cited on the violation notice and return it to me within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Description: Based on observation and record review, the center failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group. *For two-year old children: one staff member for every eight children; *for children from three years to the age of eligibility to attend public school, five years by September 30: one staff member for every 10 children. Evidence: 1. One staff was observed with a group of nine children ages two-four years when the class was reviewed at 10:20am. a. The staff working with this group reported that four of the children in this group were two years of age. 2. A review of the attendance records indicated that the ninth child arrived at 9:37am. 3. A second staff was needed as the youngest child in the group was two years of age.

Plan of Correction: We immediately corrected our ratio violation during the inspection. All staff have been retrained on class ratios and procedures for immediately notifying management if their class goes out of ratio.

Description: Based on record review, the center failed to ensure that the written record of children's serious and minor injuries shall include an entry regarding any future action to prevent recurrence of the injury. Evidence: The written injury report for an injury that occurred in the preschool classroom on 2/5/2016 lacked documentation regarding future action to prevent recurrence of the injury.

Plan of Correction: All staff have been retrained on ensuring that all injury reports are filled out completely on the day of the injury or incident.
