Technical Assistance:
-Discussed with the floating director and staff that children must be supervised and staff to child ratios must be met at all times. -All staff should be aware of all children's allergies and if a different staff member is covering a classroom, staff should know where to the Allergy List is posted.

Comments:
An unannounced complaint inspection was conducted today regarding staff to child ratios, supervision, staff qualifications and care and protection of children. Classrooms were observed, interviews were conducted and documentation and records were reviewed. There was not preponderance of evidence to support the allegations regarding ratios and staff qualifications; however, the complaint was deemed valid with regards to supervision and care and protection of children. Complaint related violations and other non-related violations are identified in the Violation Notice. Complaint related: No
Description: Based on record review, staff records were incomplete. Evidence: Documentation of at least two references were not observed for Staff G.

Plan of Correction: References have since been obtained for Staff G.

Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on staff interviews, documentation review and incident reports, when supervising children, staff did not always ensure their care, protection and guidance. Evidence: 1. Two teachers traded positions during lunch time in the Intermediates (3yrs.) classroom and Child 2 (3 yrs. old) was given milk, although dairy products were listed as a known allergy in the chid's record. After ingesting the milk, Child 2 immediately began to spit it out due to a dairy allergy. 2. A menu, with Child 2's name at the bottom, was posted in the Intermediates classroom, with all foods highlighted in yellow that Child 2 is allowed to eat. However, Child 2's name and known allergies were not observed documented on the Allergy List that was posted in the classroom. 3. A total of eight Incident reports were completed for Child 3 (3 yrs. old) between the dates of March 26, 2016 and May 24, 2016. Three reports revealed that Child 3 hit, kicked and spit on other children, while five reports revealed that Child 3 bit other children on the finger, hand and arm.

Plan of Correction: Allergy lists have been verified and updated, and have been reviewed with all staff in building. Administration has personally posted allergy lists in all rooms, since each teacher has previously been given the list but it appears this classroom had not retained theirs. The school continues to work with the behavior of Child 3, as well as working with other professionals to resolve the issue. Staff have been retrained in how to effectively support Child 3 to prevent behavior, since triggers for the behavior are clear. We will reevaluate upon further incidents and change the behavior management plan as needed.

Complaint related: Yes
Description: Based on interview and documentation review, children under 10 years of age were not always within actual sight and sound supervision of staff. Evidence: 1. On October 22, 2015 a two year old child (Child 1) left out of the Before/After classroom and walked down the hallway to the Beginners (2yrs) classroom. 2. Staff A, who was alone supervising children in the Before/After classroom, was not aware that Child 1 was no longer in the classroom. 3. Child 1 was found when another teacher arrived to the Beginners classroom with a group of children. The amount of time that the child was alone and unsupervised was undetermined.

Plan of Correction: All staff have been trained in supervision. With the onboarding of a new director, stronger monitoring systems will be in place as well to avoid further supervision issues.

Complaint related: No
Description: Based on record review, the center did not obtain original background checks prior to the first day of employment or before 30 days of employment for staff. Evidence: 1. A sworn statement or affirmation was not observed documented for Staff E, who was hired March 8, 2016. 2. An original search of central registry was not observed documented for Staff F, who was hired September 16, 2013. A copy of the form that had been returned to the center for corrections, dated October 18, 2013, was observed in the staff record. A completed, original form had not been obtained.

Plan of Correction: Both forms have been resubmitted and new director has implemented a more effective filing and follow up system to ensure no further issues.
