An unannounced complaint inspection was conducted on April 25, 2016 in regards to supervision and special care provisions and emergencies. The licensing inspector reviewed administration, physical plant, staffing and supervision, and special care provisions and emergencies and background checks. The portion of the complaint regarding special care provisions and emergencies has been deemed to be Not Valid. Based on observation, staff interviews, a review of documentation and inspection of the facility, there is a preponderance of evidence that the supervision portion of the complaint is deemed to be Valid. There were other violations found that were not reported. Areas of noncompliance are identified on the Violation Notice.
Standard #: 22VAC40-185-40-E Complaint related: No Description: Based on review of documentation and inspection of the facility, the licensee did not follow the center's own policies and procedures regarding playground safety. Evidence: 1. During the inspection conducted on June 23, 2016, the center's playground safety plan indicates that children must be closely supervised while on the playground and maintain teacher/child ratios and that children are not allowed to climb or hang on the fence. 2. The written playground safety plan developed by the center was not followed as a child was injured while climbing on the fence, additionally, the teacher/child ratio had not been maintained on the date of the injury. Plan of Correction: The storage box will be removed from the fence. We have taken the metal piece off of the fence that may have contributed to the injury. Teacher-child ratios have been corrected.
Standard #: 22VAC40-185-70-A Complaint related: No Description: Based on record review, the licensee did not ensure that each staff member's record was documented with all required information. Evidence: During the inspection conducted on April 25, 2016, the record for Staff #1 included documentation that one of two or more references as to character and reputation as well as competency were checked before employment. Plan of Correction: An additional reference has been added to the staff person's file.
Standard #: 22VAC40-185-270-A Complaint related: No Description: Based on observation and inspection of the facility, the licensee did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin. Evidence: 1. During the inspection conducted on April 25, 2016, the licensing inspector and representative with the local department of social services observed on the playground, a plastic outside storage bin positioned against a metal chain link fence. The tie wire on the fence had become detached from the post causing a jagged end that could entangle clothing or skin. 2. On April 20, 2016, a child was injured after attempting to climb the fence by standing on the storage bin. The unsafe conditions of the storage bin being placed against the fence, along with the loose, exposed tie wire may have contributed to the child being injured. Plan of Correction: The storage bin will be removed. The broken metal tie has been removed. Other areas of the fence have been inspected.
Standard #: 22VAC40-185-350-E-2 Complaint related: No Description: Based on inspection of the facility and staff interviews, the licensee did not ensure that staff to child ratio's were maintained for children 16 months old to two years: one staff member for every five children. Evidence: 1. During the inspection conducted on April 25, 2016, multiple staff interviews confirmed that Staff #1 was supervising 12 children on the playground alone on April 20, 2016. The youngest child in the group was confirmed to be 18 months old. 2. There should have been at least three staff members on the playground. Plan of Correction: The ratios have been corrected.
