22VAC40-191 Background Checks (22VAC40-191)
Today an unannounced monitoring inspection was conducted beginning at 12:30pm. A self-reported incident was also investigated which was received in the licensing office by facility administration on 7/19/16. The self-reported incident regarding feeding the wrong infants the wrong food and bottle is valid and noted on the violation notice. Today there were 93 children present with 11 staff. Most classrooms were napping or waking up from nap during this inspection. The school age classroom was observed having quiet free play. Seven staff records, six children's records and six medications with authorizations were reviewed today for compliance. This inspection, including the exit interview, ended at 3pm. Standard #: 22VAC40-185-40-E Description: Based on staff interviews and written staff statements, center staff did not ensure that they were following the center's own policies and procedures for feeding children. Evidence: On 7/19/16, staff #1 served a bottle of breast milk labeled with child #2's name on it to child #3. This was noticed after child #3 finished the bottle when a teacher was washing it and noticed it had a different child's name on the bottle. On 7/19/16, staff #1 also served a solid food labeled with child #2's name on it to child #1. This also was not noticed until after child #1 ate child #2's solid food. Staff #1 stated in their written statement that they were unaware that the policy was to check the food labels to ensure the correct food or bottle was being given to the correct child. Plan of Correction: When other staff in the classroom noticed this, they immediately reported to the Principal. Staff #1 was put on administrative leave immediately on 7/19/16 and terminated on 7/21/16. We have reviewed all policies and procedures for feeding infants and children with staff.
Standard #: 22VAC40-185-70-A Description: Based on a review of staff records, two staff (#2 and #5) are missing complete required documentation. Evidence: Staff #2 has a start date of 6/7/16 and staff #5 has a start date of 7/20/16. Neither staff have documentation that references were checked or received prior to their first day of assuming job responsibilities. Plan of Correction: We will verify the references provided and document them in each staff file.
Standard #: 22VAC40-185-260-A Description: Based on discussion, there is no updated annual fire inspection. Evidence: The most recent fire inspection is dated 10/3/13. This continues to be a repeat violation. Plan of Correction: We called the fire marshall's office on 7/27/16 to schedule the inspection. We will keep calling to follow up for an annual inspection. We will fax this to the licensing office as soon as we receive it.
Standard #: 22VAC40-185-270-A Description: Based on observation, the preschool playground has broken equipment that has not been removed. Evidence: There is a car on the playground that children sit in and move around with their feet. The car is missing a front wheel and not removed from the play area. No children were observed using or attempting to use it. Plan of Correction: We will remove this immediately.
Standard #: 22VAC40-185-340-D Description: Based on observation and discussion, a staff member meeting the qualifications of a program leader or program director is not regularly present in the school age classroom. Evidence: During an inspection of the school age classroom, one assistant teacher (#10) was present with 16 children and no additional staff. Staff #10 does not have minimal qualifications for a lead teacher. Plan of Correction: The lead teacher was on a lunch break and we thought being in in compliance with ratio would meet the requirements. Until staff #10 has minimal qualifications, we will make sure they are not left alone in sole supervision of the children.
