22VAC40-185 SPECIAL CARE PROVISIONS AND EMERGENCIES.
The licensing inspector for Bright Beginnings Crozet conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 6/9/16. Interviews were conducted with staff, family members and a child relating to the allegations regarding care and protection of children, communication with parents and discipline. The information gathered during the investigation does support the allegations, so the complaint is determined to be valid. Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on interviews, the center failed to seek medical attention for an injury to a child that occurred at the center on 6/8/16. Evidence: 1. Per Staff 1, at approximately 10:30 A.M. Staff 1 was alone in the classroom with her class reading a story. Staff 1 spoke with child 1 several times about bothering her friend but the child continued to not listen. Staff 1 assisted child 1 to stand and move to the front of the classroom with the teacher by taking the child by the arm when the child dropped her weight. At that point the child advised staff 1 that she hurt her arm. Staff 1 advised Staff 2 what the child said. They then informed Staff 3 who stated to keep an eye on child 1. They put ice on the child's arm and watched her the rest of the day. The child complained several times throughout the day that her arm hurt. Staff 1 asked Staff 3 if she should stay and talk to the parents and she was told no. 2. Per Staff 2, she was not in the room at the time of the injury. When Staff 2 returned to the room, Staff 1 advised her that the child reported that Staff 1 hurt her arm. They proceeded to inform Staff 3 and put ice on the child's arm. Staff 3 stated to keep an eye on child 1. At lunch the child complained that her arm hurt too bad to open the things in her lunch box so Staff 2 had to assist her. The child complained several more times throughout the day. When the parent picked child 1 up around 5:15 P.M. and asked Staff 2 why the child was not acting like herself she told the father she had not been acting like herself all day. Staff 2 stated Staff 3 told her to only tell the parent about the injury to the child's arm if asked. An injury report was not completed until the next day and was never given to the parents. 3. Per the parent, child 1 was picked up around 5:15 P.M. The parent stated that normally at pick-up the child would run to the parent and be excited he that the parent was there. This day the child was very "subdued and lethargic". When the parent questioned staff 2 she stated that child 1 had been like that today and maybe she is getting sick. On the way home child 1 started to complain that her arm hurt and when the parent took her out of the car seat she began to cry and state do not touch my arm. Shortly after that the parent took her child 1 to a medical facility where she was diagnosed with a fracture of the radial bone. Child 1 told her parent that while she was sitting on the carpet with a friend Staff 1 wanted her to move so Staff 1 grabbed her arm. 4. The child stated staff 1 "squeezed her arm" and "it feel hurted." 5. Additional interviews with staff revealed the child was injured at the facility in March during a similar situation when child 1 dropped her weight when Staff 4 was assisting the child to the table from the floor. The child received medical treatment at that time and was diagnosed with nurses elbow. Staff 1, 2 and 3 were aware of the child?s medical history. Plan of Correction: Whenever a child receives an injury parents will be notified immediately and made a part of the decision making process on whether to seek medical attention. If at that time the parent decides not to seek medical attention the child will be watched to ensure no further symptoms occur. If a severe injury occurs the child can be taken to the physician across the street per our policies or the paramedics will be called. Parents will be contacted immediately. All staff were retrained on policies and procedures 7/20/16 and the correction plans for this complaint will be reviewed with staff during the staff meeting on 8/2/16.
Standard #: 22VAC40-185-350-E-4 Complaint related: No Description: Based on interview, the administration failed to ensure ratio requirements of one staff member for every 10 children ages three to the age of eligibility to attend public school was met. Evidence: 1. Staff 1 stated the youngest child in her class is three years old. At story time around 10:30 A.M. on 6/8/16 staff 1 was alone with the children. Staff 2 had stepped out of the room 15 to 20 minutes. 2. Staff 2 stated she was out of the classroom for 15 to 20 minutes around 10:30 A.M. on 6/8/16. No other teacher was sent in to assist staff 1 while she was out of the classroom. 3. Staff 3 states on 6/8/16 staff 1's classroom had 16 children present. The class has 20 children enrolled. Staff 3 states she tries to send in coverage for staff 2 when she has to leave the room but she does not always have enough staff to cover. Plan of Correction: The center now has two extra staff that are not used in ratio to fill in as needed.
Standard #: 22VAC40-185-550-K Complaint related: Yes Description: Based on interview and a review of documentation, the center failed to notify the parent immediately of a child?s serious injury. Evidence: Staff 1 and 2 both stated that they were aware that child 1?s arm was hurt on 6/8/16, and that they knew the child had a history of nurses elbow, but that the parent was not informed of the child?s injury. Plan of Correction: Per current policy, staff are to call parents any time first aid is provided for a child's injury and if immediate attention is needed staff will take the child to the physician across the street or call the paramedics.
A whistle blower policy has been put into place to encourage staff to go over their immediate supervisors head if they feel policies are not being followed.
Staff were trained on these policy 7/20/16 to ensure they understand the policy.
The administration has accepted staff 3's resignation.
Standard #: 22VAC40-185-550-M Complaint related: Yes Description: Based on interview, the staff failed to maintain a written record of a child's serious injury on the day of the occurrence. Evidence: 1. Staff 1 and 2 both stated they were aware that child 1?s arm was hurt on 6/8/16, and applied ice to the child's arm. They stated per policy they should have completed an injury report but did not do so until the next day when the investigation regarding the incident was started. 2. Staff 3 stated she was not sure why an injury report was not completed. 3. Staff 3 was questioned about a previous injury the child obtained in March, and staff 3 was unable to provide an injury report for that injury. Plan of Correction: Per policy injury reports are completed for all injuries. This policy was reviewed with staff on 7/20/16.
