22VAC40-191 Background Checks (22VAC40-191)

In response to a self-reported incident received by the lciensing office on August 4, 2016, an unannounced inspection was conducted on August 8, 2016. The inspection investigation is regarding forbidden action which occurred on July 29, 2016. Interviews were conducted and video footage was reviewed, the preponderance of evidence does show the allegation to be valid. Violations related to this incident are detailed in the violation notice. Standard #: 22VAC40-185-400-B
Description: Based on interviews conducted, it was determined that a staff member did not provide behavioral guidance that was constructive in nature, age appropriate or intended to redirect Child #1 to appropriate behavior. Evidence: 1)Staff #1 explained the reason of placing her legs/knees over the child was to help the child nap because at times Child #1 is playing and whining during nap time and not being quiet.

Plan of Correction: 1. Staff #1's employment was terminated. 2. All staff members will participate in positive guidance training in addition to appropriate nap time procedure training.

Standard #: 22VAC40-185-410-2
Description: Based on interviews conducted and a review of video footage records, it was determined that a staff member engaged in forbidden actions as a means of behavior guidance of a 3 year old child. Evidence: 1)Based on video footage, on Friday, July 29 2016 at approximately 12:47pm Staff #1 sat perpendicular to the mat where Child #1 was laying down on their stomach for naptime. Staff #1 then placed their legs over the child, the staff?s knees were draped across the child?s lower back and part of their legs. Because the child is covered with a blanket it is unclear if the staff member?s legs are touching the child. 2)At 12:50pm, Staff #1 changes position and lays parallel to the child?s mat and places her right leg over the child and the child?s mat. 3)At about 12:59, Staff #1 gets up to help another child during nap time.

Plan of Correction: 1.Little Ambassador's Academy (LAA) Administration held an emergency staff meeting to review appropriate nap procedures with staff members. Topics included: frequent monitoring of all children at nap time, giving children a quiet activity to participate in if children are restless during nap time and staff body positioning/placement with children at nap time. 2. Administration met with Staff #1 and discussed appropriate nap time procedures/policies. Staff #1 was placed on temporary suspension pending the investigation findings. 3. Entire program staff will participate in positive guidance training in addition to appropriate nap time training/policy review on staff development day. 4. Employee policies regarding positive guidance and nap time procedures will be revised and updated.
