The licensing inspector initiated an unannounced complaint inspection in the center on August 4, 2016 and completed it on September 21, 2016 in response to a complaint that was received by the licensing office regarding staffing and supervision. Interviews with staff members and parties involved were conducted. Based on interviews and a review of center documentation available during the investigation, a preponderance of evidence does support the allegation regarding staffing and supervision therefore the complaint is determined to be VALID. Standard #: 22VAC40-185-40-E Complaint related: Yes Description: Based on interviews with center staff and other parties involved, it was determined the licensee did not follow their own policies and procedures. Evidence: 1) It was determined the licensee did not follow their own policy related to arrival and departure of children. The centers policy states " Children will not be released to anyone under the age of 18. Directors must see the person(s) picking up the child(ren)." The departure policy was not followed as child #1 was placed in the child watch area, and released to a person who was not on child #1's pick up list. 2) It has been confirmed through interviews that approximately once per week an average of 1 to 2 children are in the child watch after the summer camp program ends at 6:00p.m. and stay an average of 15 to 20 minutes . The program director confirmed there have been days during the 2016 summer camp program when "the staff can't stay past 6:00 p.m. and then the children go to child watch if the parents are late to pick ". Plan of Correction: The child watch is not used for after hour care for summer camp.
Standard #: 22VAC40-185-200-A Complaint related: No Description: Based on interviews with center staff, the licensee did not ensure the center always had a qualified program director who meets one of the director qualifications who is in the center at least 50% of the center's hours of operation. Evidence: During interviews on August 4, 2016, staff #1 identified herself as the designated program director and a review of the staff record confirmed staff #1 does not meet the qualifications for program director. Plan of Correction: The center is applying for a variance.
Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on interviews with center staff and other parties involved, it was determined the licensee did not ensure when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: On August 3, 2016 child #1 was placed in the child watch area, a room designated to provide childcare to parents while they are on site using the fitness center. The parent of child #1 was not on site and had not given permission for child #1 to be placed in the child watch area which is not a part of the licensed child day center. When the parent arrived to pick up child #1 a sign was posted on the outside door of the summer camp building indicating the child was in the child watch area. The child watch staff observed child #1 when they came into the child watch area and described her as "weepy and looking as if she had been crying". Child #1 was in the child watch area for approximately 25 minutes, until the parent arrived to pick the child up. Plan of Correction: The child watch is not used for after hour care for summer camp.
Standard #: 22VAC40-185-340-F Complaint related: Yes Description: Based on interviews with center staff and other parties involved, it was confirmed that the licensee did not ensure children under 10 years of age were always within actual sight and sound supervision of staff. Evidence: On August 3, 2016 the licensed child day center's program director placed child #1 in the child watch area, a room that is designated to provide childcare to parents while they are using the fitness center. Child #1 was enrolled in the summer camp program which is a licensed child day center. Child #1 was placed in the child watch area at approximately 10:05 a.m. while the children and staff of the licensed child day left to go on a scheduled field trip. At approximately 10:30 a.m. the parent arrived to pick up child #1 from the summer camp and discovered the child had been placed in the child watch area. Child #1 was not in sight and sound supervision of a designated summer camp staff for approximately 25 minutes. Plan of Correction: The child watch is not used for after hour care for summer camp.
Standard #: 22VAC40-191-40-D-1-C Complaint related: No Description: Based on a record review and staff interviews, the licensee did not ensure any employee who is required to have background checks has them updated before three years since the dates of the last sworn statement or affirmation, most recent central registry finding and most recent criminal history record check report. Evidence: The most recent background checks in the record for staff #1 have not been updated. The sworn statement is dated 8-24-2012, the central registry check is dated 10-5-2012 and the most recent criminal history record check is dated 9-18-2012. Plan of Correction: Background checks have been resubmitted immediately.
